If I were you, I would just submit your packet on Monday. Go ahead and get the Birth certificate translated and get a copy in case you get an RFE, but I personally would rather chance that I dont get an RFE and have the paperwork in earlier than wait. Plus, if you do get an RFE for it, you wont really spend any more time waiting for the request and then sending in the translated BC than if you wait to get it translated and mailed now. But thats just me :) Wow, way too many "waits" and "RFE's" in that haha!

don't you htink I can just fax a copy of the BC and its translation?I thought u didn't need originals at that point...if I can fax it it's not that big of a wait...I don't know...

But another question came up-my fiance was just filling his 129F and q10 how he had his citizenship:

what does the question "have u obtained a certificat of citizenship in your name?" mean?

You do not have to answer this one if u r american by birth?

Yes, you can fax the copy and the translation. Keep your originals for the interview.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I was hoping we could submit our petition on Monday but now we have to wait for my birth certificate to get translated and legalized....such a long procedure...

you can still submit your petition on Monday without your bc. It would be wise to send your bc for translation on Monday as well or asap just in case they send you an rfe for that. If they do (they might not!) you will be ready to get it to them straight away. Minimal delay! And that's what we all strive for! :)

Remember: you will HAVE to translate your bc for interview, but you have plenty of time untill then.

PS

Some non-English speaking countries issue an "international" i.e multilingual bc. Of course it includes English! Try asking for one of those!I've got it!And never need to translate mine.It's good for several countries and languages :)

There are some checks on the the benecificary on this side of the petition- you provide a bio sheet. A birth certificate can be asked for to further verify information about the beneficiary. I do not know if it is something specific that triggers it (name hit, travel to the US etc) or is simply at the discretion of the ajudicating officer to determine which evidence is needed to approve the case.

We did not send in my birth certificate (I was the beneficiary) with our I-129F application. It was needed later at the interview stage.

We had no problems and did not get an RFE for it.

Good, I we didnt send one, didn't even think to send it since it wasn't asked for. Wow you have to be Karmac from Johnny Carson to know which way to go on some of these things.

I didn't send one either, I hope we won't get an RFE for it. But it's good to know that we can fax it! I would think they should just have everyone send it in the first place, in case they need it, instead of making us wait longer if they need it for SOMETHING...It would be interesting to know how often they RFE for this in each place i.e. CSC vs. VSC, etc. Sometimes I really regret that we will be living in California, and had to file there, since they are so slow, and seem to send more RFEs...

No, it is not required , but some folk here ( including myself ) send them in anyway. Should you choose to do so, make sure you have both the beneficiarys original COPY accompanied with proper translated COPY.

Why do they issue RFE's if it is not a requirement? Cos they can.

Why do you think the original copy if needed? my fiancee only one original copy and i am not going to send that one. I am sending one 'scanned copy' of the orginal birth-certificate and a copy of the certified english translation for the same.

I think it all depends upon the adjudicator who will look into your case... Some cases got approved even thought they did not send a copy of it, some received RFE... Although beneficiary's BC is not really listed in I-129F's requirements, if you have it, send it in. I'm sure it won't hurt your packet as long as (for foreign language) it has a copy translated in English. We did send in our packet a copy of my BC not because I've read about it somewhere, but because I thought it would help our case. It was just a mere hunch and we're so glad we included it.
