I 751 denied, PLEASE HELP :(

Thank you for the responses! So can I re-file I-751 since in the denial notice says my status is terminated. It says I can file I-290B to reopen or reconsider the case. I made an infopass appt at my local Uscis but it is 10 days from now which is the earliest I can get. I called the uscis 1800 number to speak to a representative and she suggested me to do what the denial letter told me to, she even said the IO at my local Uscis probably just say that the same thing. I already filled in form I 290B motion to reopen form but have not sent yet.Should I wait after the infopass appt to see if there is something else I can do? Sorry everybody I'm so upset and confused now, I appreciate all your help !

Would the whole process start from scratch? Given that you are going to file VSC, it would take another 9-10 months to get to this point again. But since last time you were denied based on failure to show up to interview maybe they could immediately send your case to local field office again and schedule for another interview.

You naturalization eligibility must be coming up soon. Maybe it is better you also file for naturalization as soon as your eligibility begine. No need to lose any more time. Good luck!

Well they will be re-filing the I751 and even though the I751 is pending you can still apply for naturalization. The whole forum is full of "N-400 while I-751 pending" threads. Either google it or just search in this forum.

But not sure how the first termination affects naturalization application. Hopefully someone with similar experience can respond.

Maybe at your infopass you can ask the officer if you qualify for naturalization application. No need to pay them application fee, if they are going to reject immediately.

You were properly denied because the fault was yours, so any motion to appeal/reconsider is very unlikely to be successful. And you'll probably waste a year or so waiting for the denial of that appeal.

Re-filing is what you should do.

Like i said before, those customization seem simple to us but it takes funds to be able to add that on top the current functionalities. Limited funding and bureaucracies makes it an uphill battle to make simple changes. I work in a govt agency and I know this for a fact. USCIS do not have to give you a tracking number. The tracking is for their own use. To make sure what needs to be mailed is mailed and when it was sent out.

The traditional mail is more reliable than the internet.

It seems like you expect too much from a government agency.It is 2016 but lots of agencies are still working with archaic software which have been functional and efficient for their organization workflow. It takes decades for changes to happen , if they do. Your representatives decided how much to give them so be mad at them. And by the way, $1 or even $10 fee increase can't do much.

Don't expect much to change, use what is available and work with it.

in your case I will file a new I 751. you have 30 days to refill after the denial notice. a motion to reconsider will not help you. it will be a waste of time since the fact that you fail to check on your mail is not a good excuse for the immigration officer.

Congress controls their spending..They don't use the user fee as they wish. Congress approves and authorizes spending and budget for USCIS under DHS.The agency I work is basically user fee funded as well. It has taken Congress years to approve technology update to move on to a more "update" platform.

What I have been trying to tell people is that, it takes a very time for "simple" changes to happen in any branch of government even if they control is in the hands of that agency. We are dealing with politicians and nothing happens overnight. The option is to spend the least, provide the most basic and efficient system.

Yes, they need to let us know more about the case without calling them / would be nice to know what is happening

but i suspect most of the time it sets in an inbox

You can try. Enclose an explanation of the late filing with the I-751 and you may get a sympathetic adjudicator that will let your application proceed.

Traditional mail if the official way of communication for all government agencies because they can actually be tracked and proof of delivery can be obtained. They don't have show that because 1. it is either not covered due to limited funding for such customization,

2. not everyone has internet access so they can't use the internet as the means of notifying applicants about their case.

OP understands it's her fault. It is not USCIS fault.

I hope they even send an email. I myself tried to track my WAC for 8 mos now and still can't be found. We pay for the fee, I hope USCIS do better than this. I don't agree with everybody has no access with the internet? That's why we put our email in the application.

Good for you that you get emails from them? I even called them to do that. Yes, I get the mail but not the email nor the update online.
