SCRANTON, Pa. - There is no evidence to back up the Hazleton mayor's claim that illegal immigrants are destroying the quality of life in his city, an ACLU attorney told a judge Monday at the start of the first federal trial on local efforts to curb illegal immigration.

"Even if illegal immigrants really are wreaking havoc on Hazleton, that doesn't change the legal analysis" that the former coal town's crackdown on illegal immigrants usurps the federal government's role, said Witold "Vic" Walczak, the Pennsylvania legal director of the American Civil Liberties Union.

Hazleton officials last summer passed the city's Illegal Immigration Relief Act to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that employ them. A companion measure requires tenants to register with City Hall.

Hispanic groups and the ACLU sued, contending the measures are unconstitutional.

Kris Kobach, a University of Missouri law professor representing Hazleton, said the town has welcomed immigrants throughout its history, from Irish immigrants in the 19th century to Italians in the early 20th century and Hispanics in the 1980s and 1990s.

But after 2000, "something had changed. Hazleton had seen new criminals and new sorts of crime," said Kobach, an immigration adviser under former Attorney General John Ashcroft.

The city had one murder in 1994 and didn't have another until 2001, when a killing was allegedly committed by an illegal immigrant, he said. Five more murders were committed in 2005 and 2006, allegedly all by illegal immigrants, Kobach said.

In court papers, Hazleton officials said illegal immigrants have committed at least 47 crimes since last spring, consuming much of the city's police overtime budget. Illegal immigrants were the subject of one-third of all drug arrests in 2005, and they have driven up the costs of health care and education, the city said.

In response to the ACLU argument, Kobach said Congress had clearly stated its intent that states and municipalities can help the federal government enforce immigration law. He noted that in 1996, Congress asked them to determine the immigration status of anyone seeking public benefits.

The judge barred enforcement of the Hazleton immigration measures pending the outcome of the non-jury trial, which is expected to last two weeks. Dozens of cities and towns around the country have followed Hazleton's lead.

One could also argue that in 1982, there was also "no evidence" that illegal immigrants from Bangladesh were adversely affecting quality of life in Assam.

(the Asoms and other indiginous groups had/have been protesting this issue since 1974--and it is certainly one of the ULFA's grouses against Delhi; no-one could claim any such lack of evidence after Asoms and Lalungs made it quite obvious at Nellie in 1983).

Why is this such a big issue? Apartment complexes routinely do credit and background checks on prospective tenants and have for many years. Why is it such a stretch to require legal residency to rent? I just don't get it.

Not to mention that it already is legal for state and local governments to enquire about the residency status of recipients of public benefits.

I personally have zero use for the ACLU and don't believe America is any better off by having them around. It is basically a venue of the lunatic fringe. They spend far too much time working against the best interests of the American people for lunatic causes and do very little that benefits a vast majority of Americans. They need to rename their organization to reflect the truth.

Can you all not see the problems that could stem from this? Have you not read here of the problems that LEGAL immigrants have in proving their status? Would you have your boyfriend thrown out of/denied housing because some ignoramous landlord or shopkeeper decided his papers weren't up to snuff? Do you really want Joe Bob Sheriff of Pinhead County determining what's a legit CIS document and what is not? Would you have (any user's) husband/wife on the streets or worse because his EAD expires and the renewal hasn't come in time? What about the folks who have applied to remove conditions on their PR and are carrying nothing on them, having sent in the expired Green Card as requested and no passport stamp (have you even *seen* that stamp? Any of us could fake a better one). Would you know a fake (fill in the document) if you had one in your hand?

This doesn't even touch on the many, many other immigration status types that we do not deal with here daily.

Do YOU want to register your residence with Town Hall? Sounds like that's what the companion bill will require. I don't understand the "conservative" mindset that wants these kinds of controls added to our society, but gripes against the Socialist European gov'ts (who DO track all this and more). What happened to LESS government?

Free Market much? Deny business licenses to businesses that employ 'illegals'. The businesses themselves hardly know who is 'legal' and who is not, unless you'd just have them adopt a Working While Hispanic law (as in, don't bother if you're one). And "workers". They're up for abuse here too. Working 10 days between your EADs? Feds don't care (about the employer) and CIS will forgive you. Not Hazleton.

I'm a landlord. Credit checks are not a requirement. I don't use them (well, my places don't turn over often) but the last guy I rented to essentially couldn't get housing anywhere. Curious why he was offering me so many 'alternative' ways to check him out, guess what I found out? He's been living overseas, is keeping his money over there, he and his new immigrant wife (hey, they did DCF too!) were brand new back in town with zero credit & job history etc. I would've felt qualified to recognize her documents, but would have no way of knowing if they were legit or not. I took a chance on them anyway 'cause they're nice kids ;)

Anyway, point is, *I* don't want to be determining someone's immigration status. And judging from my observations of some of my 'colleagues' in the landlord game, I'd rather they weren't checking MY papers any time in the future, either.

Geez, even the banks, DMVs and SSA can't get it (document verification) right--now every small town cop shop in the country is gonna bust them 10 million Mexicuns back home?

eek.

I've been watching this story and will be interested to see what comes of it. I think it would be much more on-point for the local communities to sue the Federal Gov't for not doing its job, especially as they seem to be wanting compensation for their expenses. I guess on the one hand, this is the ultimate American expression of NIMBY--Not In My Back Yard. Push people to 'somewhere else'--as long as I don't have to look at brown people all day.

The ACLU should be suing the federal government for not doing its job instead of targeting communities whose tax dollars are being siponed away by services the courts mandate to lawbreakers. It is supposed the be the AMERICAN Civil Liberties Union, not the Screw Americans out of their Civil Liberites Union, which is what its alliance with illegals is doing.

It also does no good to draw this issue as racists against the compassionate liberals. I would be among the "brown people", and so are a lot of the Hispanic Americans I know who pay taxes and want their government to stand up for them, not illegals.
