Hi Guys, I will be traveling international for 4 weeks and return to USA on September 11 2016. I am eligible to apply for citizenship beginning December 4 2016. I would like to send the citizenship papers on the first eligible day. However there is a rule that I should have lived in the same district for three months prior to applying. So should I wait to apply till December 11, 2016 or can I apply in December 4 itself? Thanks

If you cannot contribute anything positive to my post, please don't bother replying. There is a reason why I have to apply as early as possible.

Don't get pissed my comment. If you apply earlier than you are eligible,what is the worse that could happen?

If you have your valid reasons that meet the naturalization residence requirement then why bother ask?

A friend apply for her citizenship a month before I did but I did my oath ceremony earlier than her. All because they needed to add her to next group of people scheduled for oath ceremony and i was lucky to have been added to a group that was ready to go.

So, you trying to rush things will not fly by USCIS processing time..However, you can do early filing.. use the link below to help you do your calculation.

Have reasonable expectation... A whole week might be the least of your worries and by the way, do your own research if you want to be pissed off at comments.

Hello, can someone answer? I am eligible to apply for citizenship this december 4. However I would have traveled 4 weeks and will enter USA on September 11. There is a law that states that you have to be a resident in the same state for 3 months prior to applying for citizenship. As far as I know, being a resident in a state is different from being physically present. But I want to know for sure that traveling does not hamper residency. This is why I'm left wondering can I apply December 4 or should I wait till December 11 in order to allow for the three months?

If you're wondering why I cannot wait one week to apply, because i will have another short travel coming up in January while my N400 will be under process and I want to time the second trip such that it comes after biometric. This is why I want to apply as early as possible.

Please reply and please stop being judgmental like the one post above because then I stop getting replies. Thanks.

You should be fine. being absent for a month does not hinder the residency requirements for your distract, it's as if you went on vacation, family emergencies or travel for personal reasons unless you move after your return.

Physical Presence

Applicants are required to show that they were:

  • Physically present in the U.S. for thirty months within the five year period before applying, or (see legal basis)
  • Physically present in the U.S. for eighteen months within the three year period before applying in the case of qualified spouses of U.S. citizens (see legal basis)

In addition, applicants are required to show they have resided for at least three months immediately preceding the filing of Form N-400 in the USCIS district or state where the applicant claims to have residency (See 8 CFR §316.2(a)(5) & §319.1(a)(5)).
