Pls I was denied my cr-1 visa at the US embassy in Ghana on the 28th july 2015 and up till date they have not return the petition back to the uscis. Pls has anyone an idea how long it takes to be returned and how can we know. We have since been calling nvc and they keep telling us our petition is still with the embassy and we keep sending emails to the embassy and they dont even respond. Pls advise what can we do now or how long should we expect to wait.

Usually can take 8 months to a year to hear anything. If it's still at the embassy well there's nothing you can do. But don;t expect to hear anything from USCIS for a year from that date.

You could get your congressman/Senator involved to inquire. Maybe there's a reason it's sitting for 6 months But they can;t make your petition move.

Are you sure you were denied and told your petition is being returned? Or were you told you are in AP? What does your status say on website?

@dwheels76 thank you for the advice. Yes was denied and given 221g and the consular herself told me she was sending it back to uscis and we have all documents intact. In the 221g she gave me states it will take up to 6 months to be transferred to uscis and my wife has also called the congressman and the senator to inquire from the embassy why they have not ship our paper back for rebutal and they are on it. We are in the same situation. My husband was denied in September 2015 and it's still at the embassy though it's been updated twice since his denial. The Co stated verbally that it was being sent back but when I check the ceac website it just says his file is in AP. My congress person is sending emails and even she gets no response from the accra embassy. What can be done about this total lack of response and professionalism from this embassy?

Ahe did not, she just said she feels the marriage is meant to evade immigration. Such an insult. We have every documents and every evidence but she will not look at that.

Check your case status to see if it has been updated.

You probably should get your congressman or senator involved at this point if have legit case.

You need an aggressive senator to request that the case gets returned in a timely manner. For Accra to sit on cases they want to return for this long

is total BS. File an official complaint.

She was told it was already sent back, but that obviously is a lie. and now when she tries to contact them, she gets no response (so she says).

When requesting case location, where your physical file is, always have the senator ask for the diplomatic pouch number in which it was returned.

Why do you think it was a lie that it already was returned ?

They are required to answer the senator's inquiry.

Try your other senator and hopefully he/she will be more assertive and not take no answer for an answer.

Returned cases can take 6-12 months for a response from USCIS but that doesn't mean the embassy should sit on cases for half a year to return it.

USCIS is back logged and returned cases are not a priority so I can understand the reasoning of why USCIS takes a long time to send out

NOID/NOIR letters but not the embassy, that's bull. They should return monthly not bi annual.

However, when I called the National Visa Center, they have no record at all of anything being forwarded to them from the Accra Embassy.

I searched on how to file a complaint and filed one this morning.

That is why THE DIPLOMATIC POUCH NUMBER should be requested. If it was returned then it obviously has such number, if not then it still sits there.

Your senator was not assertive and detailed enough to get a straight answer.

Once you have that pouch number you can then ask USCIS (or NVC where it briefly pauses and is redirected to USCIS) with such number

with a service request or tier 2.

It just appears to fall off the face of the earth for about a year. The backlog has gotten worse, it used to only take 3-5 months to hear back

from USCIS. Perhaps USCIS has a hand in telling DOS to sit on the returned cases due to extreme backlog, don't know.
