we aplied for a k1 visa evrything went well they said they gonna call me back been waiting for over 10 months till i got a msg saying we sent back ur cpplicant to usa ..its been over 10 days now.when i cheked the website still saying ap.when i cheked the usc...... website saying that they sent my case to nvc in febraury 2015. means they didnt sent me back to usa or what ?? somone has the same situation before ? plz ur help

Yes this has happened many times before. If your petition is being returned to USCIS, then basically it will eventually expire. You need to either determine what might have gone wrong with the first petition, generate new/more evidence and refile, or get married and file for a spousal visa.

the K 1 is now in AP and like my friend from Youssoufia, it will remain there forever and allowed to die

Timeline

BEFORE you marry, the USC needs to do a little investigating as to why you were refused. Share every detail of what went on during your interview, questions asked, your answers, any commetns made by IO, everything with your fiance. You need to oversome any problems first. Simply getting married may very well not fix the issue. Good Luck.

as i said in my interveiw evrything went well .they gave me a paper of my right in usa . they asked me to bring an original affidavit of support so they gave me a 221g and my passport asked me to bring it to them after 20 days i went with the original affidavit of support .they took it with my passport and gave me a pink ticket and they told me we gonna call u soon ""over 10 months now'''

If it's only been 10 days that your case was sent to the US. Don't expect any changes so far. It's not a good sign though that they sent it back to America.

I would advise you to have your fiancee call the consulate during the times they are available and ask them what's going on.

Also, you should definitely go and get your passport back. But have your fiancee call and ask them what's the matter.

Salaam alaikum,

So the reason your case got sent back was because you didn't return to the consulate within 2-3 days with the information the requested on the 221g. My husband also got a 221g but because I knew what a serious issue it is to get a 221g - I demanded to be seen by the interviewing consular officer, made them interview me on the spot (they wanted me to come back the next week which would have been an insane journey 6 months pregnant from Taza) and made them clarify exactly what information they wanted. I then showed up the next day with print outs of the scanned documents they wanted (in our case it was original W-2's of our co sponsor) then my husband got his little pink ticket and his visa 4 days later.

Now that your case has been sent back I am not sure what to tell you. I think the best route would for your fiance to marry you in Morocco and then start the IR1-CR1 visa process. Your fiance needs to call USCIS - ASAP ask exactly what her next steps are - 1. are they to give them to documents that you didn't have at the interview? or 2. do something else? She needs to speak to a supervisor not a regular customer service agent because your visa case is in AP.

She should also ask what the time line is for applying for a CR1/IR1 visa after having a K-1 visa go to AP. I think seeking an immigration lawyers advice would be helpful after she talks to the USCIS people.

Husband asks commander to call main office of Protection Civile to check the status of the new vacation request and is told no one but the general can approve his request and he is on vacation: 1/28/2015

Husband stops going to work for the Protection Civile in protest: 1/29/2015

Husband goes to US Consulate to request an extension of his visa - US Consulate says they won't extend his visa however they can issue him a new one at the cost of 3000DH/ $311 -/+ and to come back the last week of the month to get his second visa- 3/08/2015

Husband returns to the US Consulate and picks up *NEW VISA* with expiration date of 09/22/2015 on: 03/26/2015

Husband's first visa expires: 04/08/2015

Protection Civile continues to pay my husband - 04/2015

The lawyer sends letters to the Ministry of the Interior - 04//2015

My husband seeks help from the Prime Minister of Morocco's political party and called the lawyer to set an appointment to check on his case: 05/6/2015

My husband seeks help from a second lawyer when the first one proves unhelpful: 05/07/2015

My husband goes to Parliment to follow up with the Prime Minister's party - set a follow up appointment at a cafe the next day: 05/08/2015

I send a letter to the Moroccan Ambassador to the United States asking for help with my husband's case (registered mail): 05/26/2015

That is strange that they gave you so little time to respond to a 221g. We had a 221g and responded to it over a month later and were given a year to respond. We had ordered a police clearance from another country which took longer than it was supposed to and we had to show up to the interview without it. The CO was understanding when we told him what happened though and just told us to send it in when we got it.

i just cheked my case again and i found that it got updated the 17 of febraury 6 days ago and still AP even they told me the 17 of last december that thEY sent it back to usa . WHAT THAT MEANS ,?
