My fiance who lives in Dubai passed her interview end of 2014 and had till march 2015 to come to USA but did not come due to family issues (her family were not in favor and did not support her). We ended our relationship but decided to get back after several months. We tried to see if we could somehow continue this process instead of having to file from beginning. She contacted embassy in Abu Dhabi and they responded to her that we need to show evidence of relationship, pay the Visa fees, retake medical exam and book appointment again through the consulate. I went to Dubai to meet her and create evidence and did everything they asked for. But when she tried to book her appointment through the consulate they are saying system is giving them error and they cannot book, and that we should ask embassy to manually create appointment for us.

Now we are trying to contact embassy, and have left several messages but absolutely no reply. Its been over a month now. We don't know if we should continue waiting or file fiance visa from scratch again! This is very frustrating. I understand it was our fault to begin with for missing the date but embassy did say we can book again and led us in this direction before turning mute!

Should i contact lawyer? Not sure if they can help or just start from scratch.

A lawyer will not be able to do anything you can't do on your own.

Your fiancee at the tine had 6 months to use the visa given to her. I could be wrong, but since she did not use it you will most likely have to start the process from the beginning again.

Since she never used the initial K1, I would think it would be considered abandoned. More than likely, her information was sent back to the US, so I am not sure why the consulate would have given her any hope, but most likely you have to start over.

You totally have to start over. That said, are you willing to risk all those fees and exam expenses should she decide to choose her family's wishes over you? I think before you refile you should have a serious discussion and re-explore the nature of your relationship. Otherwise, you will have a difficulty time after you are married if her family does not support you. Make no mistake, you aren't just marrying your fiance, you are marrying her entire family.

There was another post on this same subject recently. VJers were saying you may not necessarily have to start over and with good documented reason the visa can be reissued. BUT theirs was still within the 6 months of issue.

I would contact your congressman and have them inquire as to the status and request an interview for you. It's worth a try.
