Hello guys, I got a different answers from friend about this issue and i am very confused,
I am preparing a new joint sponsor I864 to take to the embassy after they requested a new I864 in my Cr1 interview,

My joint sponsor filled single in 2014 and 2013
and 2012 she filled jointly with her ex husband

on I864 question 19a to 19c

19a>>>I took the adjusted gross income from 1040ez
19b>>>I used the total income of 1040A
19c>> It's a combined income with her ex husband on the tax transcript

My question: DO I use her reported wage on the W2 only or her total income including her ex income too in year 2012?

You would have to have the ex also file out a I-864A if you use both incomes. If you send a tax transcript for 2012 just attach her W2 so they will know what amount us hers.

the joint tax was in 2012, not the most recent, and she is divorced and no contact with her ex so it dosent make any sence to ask for his I864A even 2014 was joint with him, I am asking wether to put the individual amount from 2012 w2 or total combined income of 2012 from the tax return since it was filled jointly with her ex.

Personally I suggest the individual income for that year.

Put the Total Income from the joint taxes that year. That is what the form asks for. So, if they had a 1040 form when filing jointly, then put what was on line 22 for Total Income.

For the question that asks for "total income" (Part 6 item 19a-c) she MUST put exactly the number for total income it says on the tax return. It doesn't matter if it's a joint tax return or not. She puts that number. She can't just decide to put a different number. If she puts a different number they will reject it.

That does not have anything to do with whether she is counting someone else's income for the purposes of fulfilling the 125% poverty level. That is determined by what people she includes in Part 6 items 3-14 (the Persons 1-4).

thanks alot everybody for help,will use amount from tax on 2012 and tomorrow will submit the 221g response to the embassy, will provide them 3 *tax transcripts and 3 *w2's.
