Wonderful! If you are so inclined please post back in a few weeks when the calendar year is over and let us know how it went.

However you realize the above just covers steps and procedures to make sure that you are not wronged in any way. You still have the (moral) issue of deciding whether or not to report fraudulent/illegal activity on someone else (your boss). There have been many suggestions in the thread already from reporting directly to the IRS- dept of labor- and Im not sure if it was mentioned but welfare fraud has its own reporting system as well.

Reporting or not is going to be a personal choice up to you alone that you will have to live with. (providing you are not forced into instigating an investigation by not being able to obtain a correct 1099).

As for the other issues mentioned in your postings (her telling people its okay to not tip and generally treating you like dirt) Well, you seem to realize that its unacceptable and you deserve better and are prepared to move on. So good for you. There are lousy people who treat their employees badly and there are decent people who dont. Best of luck finding the latter.

No, I will not turn her in. I do believe it would be a good thing to do but I'm just too busy with my life. To be honest, I wouldn't have time for myself if I ran around reporting the people in this little community. There's nothing illegal they don't do: fake marriages, fake adoptions, fake divorces, fake single motherhood, fake traffic accidents, tax fraud, welfare fraud, insurance fraud...Fake everything. Fraud everything.

It amazes me and it puzzles when many people are willing to do anything to come to this country, but once they're here they do everything to turn this country into what they ran away from.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Sorry you're going through this but it's very common for small businesses to pay people under the table and try to defraud the government.

I woukd suggest u cut your losses and always get on the books for employment. Some will 1099 or w2. There would be forms from the start of employment u fill out. If someone isn't having u prepare a tax form so they can report income ..... don't work there!

7/30/2015 Sent I130 priority mail to have tracking, I suggest you do the same.

1/15/2016 Called NVC and got case/invoice number logged into this site to pay fees, pick agent -> https://ceac.state.gov/IV/Login.aspx 1/15/2016 picked agent DS-261

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

Sept 28th update and embassy called

SEPT 29TH ISSUED FINALLY

OCT 2nd visa in hand

POE October 22nd 2016

No, you sound like an angry, judgmental person with quite some hatred in you.

The question I'm seeking answers to is what I can do about the money she borrows me and makes me pay taxes on, not how to report her to the I.R.S. And I think even how to report her to the I.R.S was my question it would be a valid one. Unless you're doing the same thing cheating on tax and exploiting immigrants you won't condone what she's doing.

may be you answered this since the 3rd of december, but

are you a 1099 employee or a w-2 employee ?

if a 1099 employee - file a schedule C with your income tax return, having the offsets show up as expenses in one of the business expense categories.

if a w-2 employee - that's gonna suck - you'll need to file a complaint, rather SEVERAL complaints to various offices, and you need documentary evidence of this wrongdoing.

Thank you for your opinion but I clearly stated she doesn't withhold taxes from my paychecks. And I also said I was going to quit.

My question is what should I do about the money she borrowed from me and then paid me back in the form of a paycheck. My understanding is when somebody pays you back the money they borrowed from you, it's not called income.

assume all of your paychecks are 1099 income.

file a schedule C with your 1040, recording these offsets as expenses.

study irs schedule C form soon.

I was her employee, but when it comes to taxes I was a 1099 contractor because the employer didn't want to pay taxes. I was not an independent contractor because I had no say at the salon. She decided what clients I was allowed to service, and she was the one who wrote the checks etc... But I was not a w-2 employee either because I was not paid by the hour, if I didn't have any client, I didn't get paid. Quite often I went to the salon, did all the job of a janitor, a receptionist for 12 hours per day and made nothing because that day I didn't have any client. If there was a client, I got 50% of what the client paid.

All in all, it was a very unpleasant experience, which I wish I hadn't gone through.

Since you are a 1099 'worker', all of her offsets can be re-offset in IRS Schedule C.

FWIW, 1099 'workers' are common in Asian Salons. Nails, Massage, Hair, Feet, whatever - and you don't make any money that day unless a client comes in for you, and ya, it's as you've described - you switch between Janitor and Receptionist, 12 hours each day.

Thank you, Darnell. It was nerve-racking working at the salon. I suffered severe panic and anxiety attacks. Had to postpone school and still see a counselor every week. Horrible experience.
