Help! Affidavit of Support

I am confused as to which document that I am going to have to submit we have just submitted the information for the Ds160 I am trying to prepare for the affidavit of support. Which document will we need to fill out the I134 or I864? Also I just recently graduated from college this summer and the previous year I worked part-time I am at the same job and just recently got a full time job but I won't start till next week. I am afraid that because I haven't been working at the above poverty rate for this entire year and my taxes from last year will be below the poverty line that they will deny the application I do have a life insurance policy ( don't know the exact amount) and also $60,000 in stocks and bonds that I inherited from my grandmother. I am so afraid that they are going to deny the application that I have asked a friend to co-sponsor which he is willing to do and is the only person that will help me right now however he hasn't filed taxes for the last few years. I see that on the application for the I134 they only ask for tax returns if you are self employed. I am so worried I don't know what to do.

Which document will we need to fill out the I134 or I864? The beneficiary will need to bring Form I-134 and supporting documents as requested, Form I-864 is used for the Adjustment of Status.

You will definitely need a joint sponsor since your income is not above the poverty guidelines. The joint sponsor will need an income above the poverty guidelines for the size of their household to include the beneficiary.

I figured that i would need a co-sponsor however what will they need to submit for documentation of proof of income? They haven't filed taxes in the past few years what will they need to prove there income?

If your CURRENT income is above the poverty line, that should be fine. Bring proof- an employer letter, and pay stubs from the new job. The fact that you also have significant assets should also be re-assuring to the IO.

Each consulate has different rules as to what they consider as financial documentation. The I-134 states basic guidelines that are for everyone, but the consulates make them more specific.

With that said, almost every consulate requires Tax returns. The only way to get around providing tax returns is if you didn't file taxes because you didn't make enough and weren't required too, or because you didn't work and didn't make any money. Usually people who didn't file taxes and have no tax return write a statement saying they didn't file last year because they were not required too due to low income or lack of job.

If your friend/cosponsor did NOT work last year or made under 10,000$ then s/he is not required to file taxes, if they made over 10,000$ then they need to file taxes. If they are self employed, they have to file taxes if they make more than 600$.


Overall proof for income for the cosponsor is the same proof they expect from you, the other documentation they could provide would be letter from employer stating how long the persons worked there, if the job is permanent, and how much they make in a year, paystubs, W2s, but most PREFER tax transcripts OR Tax returns along with W2 OVER any other form of proof.


It's not recommended to use someone that doesn't file their taxes as a cospsonor.

Usually it is the 134 form but some consulates required the 864, which is normally for AOS.

All students have this issue, where they earned little to nothing because they were student. Then they graduate and get a job. Not a problem. Current income at the time of the interview is key.

You can list those if you choose. If your new job pays well, then nothing else needed.

If the cosponsor's current income is sufficient, then that is all that is needed. Don't use one if you don't need to.

You may or may not be okay as the sole sponsor with a new job. It will depend on the embassy and CO.

Your life insurance is irrelevant.

Stocks and bonds you own can be used as assets for the affidavits.

"Hey I don't file taxes because I don't have income to declare and pay taxes. But I earn more than the minimum to sponsor." Were you lying before or lying now? Where is the proof of income and filing taxes on it? No way is this an acceptable JS.

Find yourself a qualified Joint Sponsor.

It is not true that your life insurance is irrelevant- some policies accumulate a cash value that can be borrowed against or cashed out, and are relatively liquid.

It sounds like you are well situated- if your current employment will exceed the requirements, you should be good, and the fact that you have additional assets just further strengthens your position.

I don't think you can say that. What if the cosponsor also was a former student? but now has a good income?

Nowhere I have read that there is a time length of income for any financial sponsor.

Is long time income better, sure.

Read the instructions for the 864 concerning income requirements.

The form does ask for copies of the past three years returns or tax transcripts and requires at least a copy of last years....but the form also allows one to state that they were not required to file tax returns in previous years. It does state to include a statement describing the reasons.

A self employed person would be filing tax returns. And they MUST supply the most recent tax year's return as proof of their income. So if this is the case then I suggest a different person as a joint sponsor.

The current cash value of a life insurance policy may be considered. However all assets are evaluated based on these criteria: Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included.

If your new job gives you an income that meets the requirements then you should be ok. Include evidence of this income such as recent paystubs and a signed employer letter giving position, pay rate, and length of service.

How can we add cosponsor?? Is that to be mentioned on DS-160 or in I-134?
