Federal judge says Texas can refuse to issue birth certificates to children of illegal immigrants! wow.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Read the story prior to commenting. They are requiring valid ID to obtain the birth certificate most likely to prevent just anyone from obtaining a BC for a US citizen to use later to gain immigration benefits or to commit fraud. There is nothing unusual about requiring proper id to obtain a vital record.

BS. They are refusing to accept foreign ID's even though it is legal. They are refusing to accept passports without a valid visa even though this is a valid form of ID. Texas should give the same consideration to the resto of the constitution as they do to the second amendment.

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

BS. They are refusing to accept foreign ID's even though it is legal. They are refusing to accept passports without a valid visa even though this is a valid form of ID. Texas should give the same consideration to the resto of the constitution as they do to the second amendment.

Is the irony lost, that Texas, of all states, should presume to decide who is and who isn't a US citizen?

Wasn't it just a few months ago that the state legislature tried to pass a bill blocking the issuing of same sex marriage licences? I guess the constitution is really great when you just pick and choose the parts that suit you.

The constitution is great when it enforces the will of the majority. It becomes a pesky old rag when it's used for equality and justice for all, including minorities.

From reading the story i can see both perspectives et al.

I just dont get what does one presume happen to these phantom kids, citizens of no where? if two people go in and 3 people come out that kid is a USC. How are these kids going to retroactively prove they were born where, citizen of where ...etc after the fact.

There are those who believe the 14th amendment doesn't apply to these kids. This is how they get what they want without actually changing the constitution.

There is a process in place to effect the desired change; all they need do it follow it.

There are those who believe the 14th amendment doesn't apply to these kids. This is how they get what they want without actually changing the constitution.

Like with the marriage licenses, it's just people ignoring the actual law and doing what they feel like doing. I assume an actual legislated policy would have to be constitutional, thus including a provision for the children to get the birth certificate somehow, unlike what's actually happening right now.

Bingo. The actual issue is not the issuance of the birth certificate, but the real purpose is to find a manner by which to circumvent the Constitution and deny these babies - anchor or otherwise - their right to US citizenship by denying them their birth certificate.

If that's what people want, then there is a process for that. Just as there is a legal process to determine what forms of ID are acceptable.
