Hello, my boyfriend is going to apply K1 visa for me. Form the very first step, we are confused about the I-134 affidavit.

His income for last year was only $8000, so he wants to ask his mother to be the co-sponsor, but the question is her mother files tax return with her husband(my bf's father) together, how many people should be the sponsors and how much should their income exceed?

My bf just wants his mother to help us so we wonder can she be a seperate sponsor from his father.

And what kind of documents have to be submitted for him and his mother for the affidavit? Thanks a lot!

Your USC fiance cannot apply for a visa for you. You will apply for a visa for yourself. To start the process, the USC fiance will file an I-129F petition. When the petition is approved, that will grant you the eligibility to apply for a K-1 visa at the consulate in your country.

When it comes time for the K-1 visa interview, then the USC petitioner will need to provide an I-134 and supporting documentation. If using a co-sponsor, they will fill out their own I-134 and provide supporting documents. If the mother earns enough on her own for her household size plus you, the foreign fiancee, then she can fill out an I-134 and provide her most recent tax return plus proof of current individual annual income.

The consulate usually provides instructions on what will be required at the K-1 visa interview.

What country are you in? Not all countries are co-sponsor friendly for the K1.

I'm in Macao! I will go to the US consulate of Hong Kong for Visa interview.

The main issue right now is we wonder does my bf's father also need to be the co-sponsor? Because my bf's mother files tax return with him, which means that her tax return sheets also show his information, but she and my bf are actually qualified for sponsoring me.

First, it's important to understand that there are no girlfriend visas, with petitions filed by boyfriends. You are talking about a visa for a fiancee of a US Citizen. The petition package requires letters of intent to marry, signed by each of you.

Your fiance's income last year is not an issue. What is important is his current income at the time the affidavit of support will actually be completed, months from now. Is he working and currently making enough to qualify? If so, his parents need not be involved.

First, it's important to understand that there are no girlfriend visas, with petitions filed by boyfriends. You are talking about a visa for a fiancee of a US Citizen. The petition package requires letters of intent to marry, signed by each of you.

Your fiance's income last year is not an issue. What is important is his current income at the time the affidavit of support will actually be completed, months from now. Is he working and currently making enough to qualify? If so, his parents need not be involved.

He has a job in 2015 and according to his estimation, his income of this year will be around $13000, since he was still a student in 2014 and 2013, we are not sure is he able to sponsor me on his own. But if not, he said he + his mother will definitely be enough (his mother makes $17000/ year). Does it work?

And I also have a question that besides the letters of intent, we have written another letter about our story: how we meet, how we star to be together... what should this letter call? Is it required?

The correct verbiage is your fiance will file an i129F petition for you, you will file for the K1 visa at the embassy at a future date. The letter you wrote is the answer to one of the questions on the I129F petition.

His income is definitely not enough to sponsor you alone. As long as your embassy accepts cosponsors for the K1 he can use his mother's income to help. Check the limits online for the I134 affidavit of support, which you will need to bring to your interview. I don't know the threshold limits off the top of my head.

You can only have ONE co-sponsor. It should be okay that his parents file jointly (the tax returns and W2's will show which parents makes how much). Basically, you cannot combine income at all. ONE person has to meet the requirements, whether it be your fiance, his mother, his father, but no combining incomes.

I'm not sure what the guidelines are right now, but it is based one household size.

Most places use 125% for the poverty line, while on paper it says to use 100%, the consulate officer has complete descretion as to what they want to use, in reality there is no reason NOT to use the 125% because you're planning on staying in the US and you will have to meet the 125% anyways once you're in. Your fiance will need to make 19,912$ a year, if not, you will need to find a cosponsor with no dependants that makes 19,912$.

You can not combine incomes, so either your fiance has to make that by themselves, or the cosponsor has to make the needed amount by themselves.

The I-134 has now question about last year's income or 2015, in come or any specific year. It asks for current income. So, take how much your fiance earns in gross earnings per week or two weeks now and multiply by 26 or 52, as applicable. If that number is enough, then he qualifies and you can forget about using parents.
