Hope someone who has knowledge can explain to me as me and my husband are so confused right now and he gets so upset.

My husband is divorced and has 2 kids.he and his ex wife claimed each kid on tax declaration.now he is going to file an aos but confused if he is going to count and include the other kid in his computation to meet the poverty guidelines.the problem is if he include the other kid his income for last years are not enough but his income for this year with his overtime are enough to meet the guidelines for 4 person.

All minor children no matter where they live are counted in the household count. Your husband's count will include both children.

He would not count the other child. Someone else claims him as a dependent and pays for his living expenses. Unless your husband pays child support, if so, then he would have to include him.

This is incorrect. Evidently, you have not carefully studied the I-864 instructions. Doing so, (with every form) is critical to the ultimate success of any do it yourself immigration process.

Facts are cheap...knowing how to use them is precious...
