Ok so my husband had his interview on June 4 and they were asking him has he ever been in a gang he said no to make a long story short he got denied do to reason to believe he is affiliated to criminal active so what do I do from here do we have a chance to come together again legally we have been married for 8 years have 4 kids together I'm just sad I talk to my lawyer and they will fight this but I'm scared they won't let him back

I ask my lawyer can we just cover it up she said no let's fight it never been to jail never got arrested clean record here and in Mexico I'm so lost I don't no what to do I'm worried

It is the laugh now cry later tattoo I don't no what he was thinking when he got it I have 4 kids no family he haves no family I am stuck what do u think r chances r

The lawyer said we have to change their minds and prove he isnt in any gang so far the tattoo is in LA and in Guatemala no Mexico or Michigan so idk I'm lost

USCIS has a database of tattoos that are associated with gangs from all over the world. If his tattoo falls into some of these categories he may need to remove it. The USCIS has discretion over the matter, and you can fight it if you want, but I think the lawyer is taking your money, and filing appeals that won't help much.

Simply having an 'offensive' tattoo, with no gang membership, and an otherwise clean record, is cause for denial?

He might as well remove it now.

I no clean record no nothing and denied I'm so lost so as we fight for the hardship wavior and to prove that we have to do the same as far as him not being in criminal active I wish someone haves the same case and a good outcome I'm scared we won't be able to win I'm trying to stay positive but they just denied him for no real proof

they are already aware of the tattoo, so removing it won't change the fact they think he is affiliated with a gang.

For what ever may happen in your journey, this tattoo must be (as seen by the officer) as somewhat offensive.

I would ask him, to remove it. It cannot hurt anything, by removing it.,.,,but maybe he has his reasons for keeping it.

I may have missed it, but I do not re-call him saying he was willing to remove it. I could have missed something..,.,,its just an opinion.

You seem like a person who wants to do the right things for your family, I wish you all the best, you need to be together, as a family.

If the denial was based on his tattoos,then removing it makes no difference cos the IO understands the meaning of it better than your spouse. All you have to proof to them is that he is of good behavior and have some relative write an affidavit on his behalf indicating his a good person

There are experts on such matters if it is not and you wish to dispute it.

Very much depends what it is, you were not clear.

When he had his interview they were so worried about his tattoo asking was he in a gang ever and a different question and go to were u ever beaten into a gang and ask him alot of question about being in a gang in different way it just states that he is affiliated with criminal active my lawyer said it's the tattoo yes it is gang related when we looked it up however it's not the same face laugh now cry later saying and the lawyer said yes he can cover it up but they still no it was there so it really don't matter

Yes he said he will be willing to remove it it doesn't mean anything to him he like the tattoo when he saw it not knowing it was a gang related tattoo cuz he would of never got it i told him I want it remove even if he approved when he comes back home he needs to remove it he agree
