Hello all,

Love this website - has provided peace of mind many a times!

K1-Visa was just approved! And I'm super happy. However, and surprisingly, the I-134 wasn't requested by the officer we spoke with at the Consulate. I had spent a lot of time preparing it and getting together all of the evidence it suggested I bring but the officer never asked.

So now I'm worried there's another set of eyes that's going to look at our case, notice the I-134 isn't there and deny the visa or something. Or the officer at Customs will look for it when my fiance gets to the States and ship him back to DR.

Since visa was approved during the interview at the Consulate - should I stop worrying? Is the process over?

If not, what other steps should I take?

It is very strange they didn't ask you for that form.It is a requirement to get the visa. I would call the embassy and ask

There will not be an issue, as the K1 visa is only good for one entry and they weren't really worried about it, they saw enough to believe the relationship is real and you were approved.

What will matter and will be required for the Adjustment of Status is form I-864 and all required documents.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

Wasn't this handed over to the employee who was collecting papers before the meeting with the consul?

If the embassy belatedly discovers that they need it, they'll be in touch. If you get the passport with the visa inside, quit worrying.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The I-134 is not a requirement to receive a K-1 visa. It is just a form that the consulate's can ask for when deciding whether or not the foreign fiance(e) will become a public charge once in the US.

9 FAM 40.41 N5.6-3 Use of Form I-134, Affidavit of Support

(CT:VISA-1995; 06-06-2013)

...

c. If you determine that any of the following types of applicants need an Affidavit

of Support to meet the public charge requirement, they may use Form I-134,

as they are not authorized to use Form I-864 or I-864W:

(1) Returning resident aliens (SBs);

(2) Diversity visa applicants (DVs); and

(3) Fiancé(e)s (K1s or K3s)

In Costa Rica it is a requirement. They email you the packet 3 stating it is. perhaps it is different in every country

Yes, your consulate requests it, and it might be required there. Different consulates have different procedures and requirements. Even when a consulate's instructions state to bring the I-134, sometimes the CO does not request or take it. The CO has the sole discretion on deciding public charge.

I was just pointing out that the I-134 is not required in order to receive a K-1 visa, and so the OP does not need to stress out.

It would be ideal if things were the same across all consulates, but they are not. Some of it can be attributed to visa fraud rates of the various countries, and cultural differences and norms for the region.

A couple years ago it became a bit more streamlined when they started requiring only the DS-160 for all K-1 applicants across all consulates. For the most part the requirements are the same though(albeit some more strict about them than others), but procedures vary more wildly. Some send packets. Some email them. Some just send a letter. Some have you pick the instructions in person. Some have you send in forms prior to having an interview. Some have you bring all the documents at the time of the interview. Some ask for notarization and translations. Some don't. Some extend the petition validity automatically. Some want you to contact them to extend it. Some ask for a new letter of intent to extend it. And so on.... See?

My sister's interviewer was not asking for I-134 either. She was interviewed in Saigon Vietnam.

It indeed seems every country is different, and different officers ask for different things.

In Manila, The Phils., my wife was asked.,.,,..,for.,. ""do you have any pictures?"" "Explain them."

That was it.,.,approved.
