overstayed J1 visa, getting married

Hey guys. I basically stayed over my J1 because I felt in love. We want to get married now. I have so many questions and concerns and need some advice.

First question: since I am illegal and want to get married, do I have to fill out any other forms than I-130 and I-485?

I've read that I have to fill out the form I -765 for work permission, I-601 for a waiver (I think I need one bc of my J1 visa) and other stuff. Are all of them included in the I-130 or I-485 form?

I have two friends who we're in the same situation like I am and they told me that I don't need a lawyer. They said it was really easy and I shouldn't worry.

Is here someone who is or was in my situation and can explain all the steps? I am going to a charla for a free consultation with a immigration attorney, I just kinda want to be prepared and get some questions answered before I go.

You do not require an I-601. You should file for employment authorisation (I-765) and Advance Parole (I-131) at the same time, since there is no charge for doing so.

Technically, the I-130 will be good and the I-485, I-765, and I-131 will be yours; you are just submitting them all at the same time.

You should also make sure that you're not subject to the two year home residency requirement that some J-1s have to comply with. You are ineligible to file if so.

I just checked. I am not subject to the two year resident requirement. Just got a little scared. I am slowly figuring everything out. I have one more question. After getting married we have to immediately apply and file out the forms or should we have everything ready to send? And would y'all get a attorney?

If you're not subject to the HRR then it should be a straightforward adjustment.

It's up to you whether you want to hire an attorney. It doesn't sound like you need one, but some people are not comfortable completing this kind of paperwork.
