Hello,

This will be the second time I'm filing for the k-3 visa. Me and my ex-fiance decided to not move to America so didn't proceed with the filing. But they did call him to come in for the interview, he didn't go though because we decided to stay in Morocco. 4 years later, I'm married to a different man. We've been together for 2 years and married for 7 months. We want to go to America and so I need to know when filing the form, it asks, "Have you filed this form before?" I guess the answer would be 'yes'?

Has anyone ever had problems because they've filed for this spousal visa before with someone else?

Yes, you need to reveal if you've petitioned for any other aliens in the past. The question also says to list the result as well so you can just say voluntarily withdrew.

By the way, the K-3 visa is basically obsolete. You'd be obtaining a CR-1 visa (married less than 2 years).

Many here on VJ have petitioned other fiance's, spouses. The answer is yes. You withdrew yours so no big thing. Just file your I-130 (You said ex-fiance so there's no way you could have gone foe a K3 . That is only for married folk).

Yeah, my ex husaband had filed K-1 for a woman before. And she did not come. So we disclosed and there were lots of questioning on the K-1. We were not sure why is all but a friend said they have it as a red flag.

He is a naturalized American and in our culture it is very common males to try to find a bride from the same culture - so a guy trying to have a relationship with different women if the some relationship does not work is very common.

It's a problem because people marry a USC or LPR for the sole purpose of getting a green card. That's not allowed and is classic immigration fraud.

If a person tries to bring different spouses/fiancés in a short time, it matches patterns of fraud. This is why it's a red flag.

Actually, I saw someone the other day that had their 129F get to the embassy before the 130. It's not completely impossible.

OP, your post doesn't really say which form you are looking at, what stage you are at, etc. If it does, I missed it.

Since you are married you will file the I-130 petition first for the IR-1/cr-1 then the I-129f for K-3. As mention the k-3 visa is not giving out that much. While still possible to get one most likely you will be doing the CR-1 visa

on the I-130 it ask have you ever file a petition for this or any other alien. Your answer will be yes. The question does not say if file a certain petition
