Hi! Thank you for all your answers!

We paid the MRV fee at BPI bank so it's legit and no one asked for a case number from NVC, we can't schedule an interview yet though. I was following the steps at www.ustraveldocs.com! We really just got confused.

This is a forum you can ask questions, to those who said it "sounds fishy", it isn't that we are doing anything bad, my fiance is here with me in the Philippines and he wants to go home with me at his side. He is looking forward to going home and introducing me to his family, we are both just very excited to be in the states!

He has been living here in the Phil. with me for 2 months already so after 4 months we could get married then file for a DCF visa? Is that what you are saying? :) or should we get married now then wait for 6 months and file for the DCF?

Isn't the fiancé visa faster to attain though?

I must assume you two are chasing a tourist visa, paying the MRV fee at BPI.

Since you paid for something, can tell us which visa category is on the payment receipt ?

Will he lose his citizenship? If a US citizen becomes naturalized to another country he loses his US citizenship. If he stays here over 6 months wont he lose his citizenship?

i suggest this -

marry now. chase after the PI visa for the USA spouse, allowing him legal presence inside the PI.

Once he has that special PI visa, the calendar starts, he has legal presence in the PI [tourist visa time not count for Manila IV, at all] ,

wait in the PI for 6 months, but during those 6 months, the USCitizen spouse should (or must):

1. get some online job with an employer in the usa, a legit job and

2. obtain a joint-sponser inside of his group of relatives, as he's never going to qualify on his own unless you two want to put it all off for 3 years.

then after having legal, non-tourist residency in the PI, he can

3. file the I-130 via Direct Consular Filing, USCIS office in Manila

your other option? he file I-129F now to the lockbox address in USA, then get a co-sponsor prior to interview day. secure a co-sponsor within his family for interview day. he not have to leave the PI at all for this route. It's highly probable Manila IV Not Accept a co-sponsor for a K-1, so keep that in mind.

I do understand that you want it fast and of course to get approved. Also, everyone here understands how difficult to be apart from their love.

But this is how I see the situation realistically:

You want it fast? Yes maybe go for k1 but... co-sponsor we don't know if they will allow... Which could make it longer...

You need a co sponsor? Go for Spousal visa they accept co-sponsor but... It takes more time than K1

You want DCF? It's fast, accept co-sponsors but... needs more time to prove relationship(some couples show joint bank accounts, electric bills in their name... Etc)

Try to weigh things. Maybe some sacrifices need to be made. Whether it's time, distance...

It's just my opinion. I hope it all work out. God bless both of you.

Best advice yet! These are the choices. Be realistic and make a firm decision. After that don't worry too much about the what ifs or wish you filed something else. Finish one step and plan for the next one.

Would the spousal visa take longer? If so, do you have any idea how long? We want to leave as soon as possible, I plan to leave with her once she gets her visa. We already paid for the interview fee but we haven't filed anything yet, we got confused which step is first. Luckily it is valid for a year but non refundable so hopefully within 3 months we could have her interview scheduled.

Me and my fiance have a kind of similar case with this. We filed the I-129F (by ourselves because we couldn't afford a lawyer) before we even know that they do not accept Joint Sponsorship for I-134. We do not know what to do now. :cry: I hope everything works well for y'all.
