k1 denied at interview now what please HELP:(

Timeline

We got green denail:(. My fiance try yo cross 7 years ago but got caught and was ask who he was with he said my cousin which they both we seperet way when trying. and so they gave him the paper it said denail because of alian smuggling, we are so heart broken. I'm trying to see where to go to appeal there decision. :( we have cried all day.Please help anyone

You may be able to file an I-601, Application for Waiver of Grounds of Inadmissibility

Page 12 goes over alien smuggling. However, it doesn't look bright.

I am so sorry this is your situation, but you guys didn't think this might be a possibility? You didn't know this might come up before going through the whole process?

No because I got foias from the borders and it was clean. He tried with a coyote so I don't see why they say smuggling? ?; ( I feel so loat right now:(

This was a family member?

Was the cousin younger?

You need an expert opinion who will know if he was accused of smuggling back then & the circumstances

If he was not a coyote, but a regular person wlth cousin yoi should do a free consult with her

I'd say this is a situation where you're going to want to get in contact with a lawyer. This could be beyond any form of self fixing.

Timeline

Try to apply for an I-601 or I-601a waiver. When my husband and I got our I-130 approved we immediately filed for the I-601a because he tried to come in to the U.S illegally in '95, he was caught and immidiately sent back to Mexico, he never made it across. He tried again in '97 and has been here ever since. He just had his visa interview on Monday and was approved! When someone says they cross over with family or even friends, it is seen as immigrant smuggling, so I am not sure if the waiver would help you in your case. I would seek legal help from an attrorney. Good Luck!
