So my petition has been stuck at TSC since December 1 :( I know CSC process them so much faster. My question, can I refile without cancelling the first one at TSC ?? (and hope it gets send to CSC this time since all K1 go there now) Has that been done before?? Any insight will be much appreciated.

no, you can't have 2 of the same petitions in the loop. You could have one as a K1 and one as the child of an LRP for instance but not 2 k1's

This will not be over quickly. You will not enjoy this.

The craziest one I read was someone that got interviewed on the same day for both visa lottery and CR1, allegedly.

Oh wow, I am not sure if that is possible.

how long does it takes to cancel the first petition? Would that pose any problem to get another one started?

Most likely yes. Canceling takes at least weeks, if not months. Sorry, you are stuck at TSC. Good thing is, it won't take that much longer...next month you will be out of normal processing time, something must be happening soon. Definitely before you can refile.

Just stick to TSC. They're seem to be faster than they've been in a long time. You would just be wasting time and money on cancelling your petition. Plus it might look weird.

I understand that but by no means are they faster!! It's the slowest they ever been in my opinion!

You have waited 7 months. I waited 8 some have had to wait 1 year or more. It could have been worse.

If you were to cancel you'd end up at the back of the waiting line plus it could take a long time until your other petition was officially cancelled.

Yes, I understand that. It is just not fair. I will not cancel my petition. I needed to know if that was even a possibility

Hello, have you tried calling USCIS, base on your time line you should be able to call them.

Calling them does not do anything, all they say is to keep waiting and that I am still "within processing time". Also the timeline in VJ is just an estimate. The processing times are still at November 10 on USCIS website. But no worries, I will keep waiting like everyone else, because I have no other choice right now
