TSC NOA2 delay, no RFE's

Newbie here,

Our NOA1 is dated March 11, 2015. It has been just over 120 days and we have heard nothing. It took USCIS 3 months to put it on their site that we have a case. Have called many times to find out status. Just found out they are pretty useless and can only tell me what i can see(at least that is what they said). TSC says it is working on I-129F petitions from October 2014, yet here it is listed as December 25, 2014. This is confusing. I am wondering if our case is being held back because it is same sex. I live in Massachusetts and my partner lives in the Philippines. I have seen several petitions filed after ours get their NOA2 and another case filed just under a month from ours and they already received NOA2 as well. I called USCIS yesterday and voiced my concern about the possibility of being discriminated against...they replied absolutely not.

Any suggestions would be appreciated,

Hi! Your application is definitely within the normal processing time.

We filed in June 2014 with a NOA1 in July 2014. Petition was approved in January 2015.

No, it's not because of the same-sex. It's because your case is in TSC. TSC is much slower than CSC. At the end of March, USCIS began forwarding all new K-1 petitions to CSC to help 'balance the workload', but it's not a good deal for March TSC filers. There is a March filer thread and a TSC only March filer thread you can join to stay connected to everyone's progress.

Our NOA1 is February and don't expect to be approved for another 4-8 weeks. Go to immifairy.com and signed up for a $10/month subscription and get a daily report that has all sorts of info.

You will get no better information than you'll be able to get here or other free forums or on uscis.gov

The $10/month I pay for the amount of information I get pays for itself tenfold. It would take forever and a day to research all of the different forums and USCIS website to get the information I get from their reports.

To each his own.

PS. I don't work for nor have any ties with the site other than a deep appreciation for doing the data mining.

I think immifairy weeds out the people that put on their timeline that they are TSC filers, but are really CSC filers (only think they are TSC because they, like all of us, sent the petition to the TX lockbox). It essentially makes SRC receipt numbers TSC and WAC receipt numbers as CSC. It removes the CSC data from the TSC timelines. They are pretty skewed on VJ right now because of the confusion.

I still don't think you need to pay for information you can easily find.

On top of that, immifairy has a community of <100 people.

No skin in this game either but the site is like a month old so what do you expect? Plus the only way you'd be able to get that info for free is to type in 10,000 recepit numbers yourself every day and record and analyze the results. That's basically what's being provided. And if you're K1 at TSC, you applied before April and God willing have a max of 4 months left. $40 for accurate information in real time daily is the math I did.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

You're being naive ;-)

And if you already did the math, what's the point of wasting money?

Nothing is guaranteed with USCIS! Some people get their approval within weeks, some people months, some people over a year - or denied.

Do yourself a favor and save the money.

Hi there,

You should know that TSC has been a problem for a while now due to backlog and maybe a whole host of other problems from just the way they do things to lack of coffee or something. Officially, yes they are working on October 2014, that is their story and they will stick to when pressed (don't let this fool you though, because they may work all over the place). That's not to say that some people haven't gotten very lucky. Please know that there are several reasons why a timeline on this website can become not as accurate as you think. Human error, misunderstanding what service center has your case, and a whole host of other factors spews out false data.

That being said, most of us that have been through the hell of TSC can tell you that presently if you are stuck there, you may be in for up to and not limited to a 240+ day wait. There were many cases from the Philippines which seemed to be expedited for humanitarian reasons for a time, though this may not be the result now or you are simply just unlucky.

At the end of March, all new cases being filed are being sent to CSC, instead of TSC for an undetermined period of time. This of course didn't do anything to help the people still stuck at TSC. From my experience it took over 200 days to get an NOA2, and that's only the first part of the process. At the time I was approved, I still watched as people who had filed well before me sat for 280 days or more to finally receive an answer. Some needed representative involvement.

Let me reassure you that you and your fiancé are not being discriminated against because of being a same sex couple. Everyone at TSC is sadly in the same boat no matter who they fall in love with. Your only recourse to urge action at TSC is to bug your congressperson or senator and see what they can do for you, otherwise it's very much a long wait.

So.....how many total February K1 filers are there and what percentage has been looked at as of today? Approved vs RFE? You may not care to know but some of us do. And if that's how we're handling this process how exactly is thay your busniess? No one says you need to sign up, just that if you want accurate up to date info that's where to find it.

Also, I spent half my career as a database and data analysis consultant to federal agencies. I know good and accurate data when I see it, to the point I know when it is worth paying for. But thanks for the pointers all the same.
