The below is my attorney's office response, why National Benefit Center not Chicago. What you guys thoughts?

Chicago is the lock box, and the mails will be accepted by the lockbox.

After the lockbox received the application, they start processing once the priority date is reached (technically it is Aug 3), and they will issue a receipt number that starts with MSC, and the case will be processed through National Benefit Center.
The Chicago lockbox does not process cases.
So, according to the office response, my case is only start process on/after Aug 3? Since my priority date become current Aug 1?

Hi all, we received an RFE last week. I had submitted an English translation version of the birth certificate, and the RFE asked for us to send the original birth certificate in the actual language, as well as the English translation.

One question: do you know if it's OK if I send a copy of the RFE letter, or do I need to send the original one? I am traveling right now, and won't have the original RFE letter in my hands till early next week. Thanks!

I made a copy, which I kept, but sent back the original. I can't see where it would be an issue though?

It sounds like your attorney did send the paperwork to the correct place. Once the Chicago office processes the application it will be sent to the NBC. The Chicago lockbox doesn't process cases.

Cases with priority dates are usually processed by that date.

Your case is different than ours and most others in the thread because we don't have priority dates. However, we are familiar with them since a lot of us are adjusting from a K1.

Personally, I would make a copy of everything you need to send and send the RFE back with all originals. At least then, you'd have a copy of everything you sent them.

Yes, pretty much all of you guys here is Citizen based petition, my is green card based petition and adjusting from F-1 international students.

So in general, my case would be only process on Aug 3rd, if its like this I would be less worried, but need to confirm it.

Thanks again Jameel and Kasey.

I have read all off your story following on your post, hope everything going smooth and you get your NoA soon. Please keep us post about your case.

(I got married when my hb still working on his N400 application and he just recently got naturalization by the end of May2015, I decided to wait because I know it will make my AOS faster. I took sometime to make money and gather all documents and just sent out package on mid July (after my J-1 Visa already expired on June) I wish everything going well too.

Good luck everyone!

For sure, my OPT will expire on Nov. 2015, so my attorney told me I have to maintain a legal status after that, like go to school again to have F-1 visa under lying because I am Green Card based petition. For you, if you hb turns to Citizen, you will be no problem of expired status, Citizen based is most likely exempt for everything.

Good luck guys!

Hey everyone,

My husband entered the country on a work visa (H2B) and then we married and filed for AOS. Do you think depending on which visa the applicant entered the country with affects the AOS timeline? Just curious, as most of the people in this thread are adjusting from a K-1 visa.

Not sure. There's no rhyme or reason to the USCIS. However, this forum that I'm linking to has people that are doing AOS from Work, Student, and Tourist Visas... http://www.visajourney.com/forums/forum/138-adjustment-of-status-case-filing-and-progress-reports/

Not sure. There's no rhyme or reason to the USCIS. However, this forum that I'm linking to has people that are doing AOS from Work, Student, and Tourist Visas... http://www.visajourney.com/forums/forum/138-adjustment-of-status-case-filing-and-progress-reports/

Thank you!

Hey everyone,

My husband entered the country on a work visa (H2B) and then we married and filed for AOS. Do you think depending on which visa the applicant entered the country with affects the AOS timeline? Just curious, as most of the people in this thread are adjusting from a K-1 visa.

By your timeline, you are AOS from the I130. You're in the right place. No need to go to tourist and student thread.

I highly doubt that the visa your husband came in on will affect your I130 or I485 in any way. If anything it would just cancel out one visa for another.

Good luck to you!
