K1-visa Cancelled without prejudice

Hello,

what is next for my fiance after his visa was "cancelled without prejudice", but the embassy says it is still under "administrative processing".

Do you know why it got cancelled? Did it says so on the status? Then it could be that they made an error and had to re-do it. Otherwise it sounds like she doesn't have a visa anymore.

You haven't given us a lot of information. If you know why it's been cancelled and it's not their fault I don't think you can expect more than the fact that the visa has been cancelled. If you don't know what has happened I suggest contacting the embassy.

My sister had that in her tourist visa - they put down wrong gender. They issued a new one with no problems.

FX similar thing with your fiance's visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

"Cancelled without prejudice" most likely came up as a status update on the case, most likely because they realized they spelled something wrong or picked the wrong gender so they cancelled it and now they're working on a new one. Most likely.

Good morning guys and thanks for your replies, they gave her the passport with "cancelled without prejudice" stamp on it.

The CEAC status show "READY" I also got an email from the embassy that says it is under "AP".

You should ask for a proper explanation because that does not sound right. If she has gotten her passport back with her passport stamped like that, her K1 visa has been cancelled.

It sounds like the petition has been returned to USCIS and the visa has been refused.

Your fiance needs and you need to get clarification on what exactly is going on and why.

If they don't tell you than do a senatorial inquiry to get some answers.

Was he given a 221g letter with anything marked or written ?

You need to give more detailed information.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I didn't realise that mine was cancelled without prejudice until I got it. I compared the two visas in my passport, and it turned out the one cancelled had my name spelled incorrectly.

If you have the former visa stamped with cancelled without prejudice in the passport, you could just look over it very closely and see what/if there are any differences.

June 11, 2015 - welcome to America letter! (no interview...no service request..)

Cancelled Without Prejudice: A stamp a U.S. Embassy or Consulate puts on a visa when there is a mistake in the visa or the visa is a duplicate visa (two of the same kind). It does not affect the validity of other visas in the passport. It does not mean that the passport holder will not get another visa.

They also do that to previous visa's that are no longer valied if you get a new one. For example you have a J1 visa and then you get and F1 the J1 will get the Cancelled Without Prejudice stamp.

However it sounds like the OP's fiance got this stamped on her visa and then did not get a new one which means they really need to contact the embassy and figure out what is going on.

We have been trying to get some answer but the only reply we got after six weeks was it is still under "Administrative Processing", and when I check on ceac website it says "Ready" not "AP".

This has been 2 months now and we still trying to get some answer.

You shouldn't accept the "Administrative Processing" answer because that can mean anything. Ask them "Why does the visa have a Cancelled without Prejudice" stamp on it?" "Have we been denied a visa and will our case be sent back to USCIS to expire or will we actually get a visa?". After 2 months without a word, it doesn't sound optimistic though.

Yeah I have sent multiple emails to the embassy and the NVC during the past two months, only one response that says its in "AP".

I have contacted my congressman for help.

Please let me know if any else I can do, thank you.
