So Ebunulowa I see that in another post u stated that sometimes CO tell applicants their application would be returned to USCIS for review but then again they change their mind and keep the application at the embassy for review. Ok so the question again is how do you find out your apication had been retain at the embassy for internal scrutiny. I checked mine at the CEAC tracker and it says AP. What does it mean?

AP would indicate that it is still in active mode being worked on, however sometimes the CO's don't update the ceac status and if it has been

returned it should state so on your status update. That's why a senatorial inquiry can shed some light on where exactly it is.

You can also email the embassy and ask for the diplomatic pouch number it was returned with, they may not answer you but will

answer a senatorial inquiry. More so than actually tracking the number it just is a way to find out where it is located.

Try entering your NOA number in the USCIS case status update https://egov.uscis.gov/casestatus/landing.do

and you can also make a service request but it takes a while for them to confirm your returned case is in their system.

After a senatorial request they usually do finally update the current status.

Call your senator's office to follow up with your online form request and speak with their immigration aid.

This is for petition location purposes, the senator can not force their hand to review the case.

Ok, I had check an hr ago and it says wrong I'd case number. But I'm gonna exactly what u asked me to do. The lawyer actually sent me an email that in his experience as a lawyer a lot of mistake people do is take advise from individuals who are not lawyers because everybody's case is different. But he doesn't mind helping me with filigree another application for me. I guess he made emphasis on the letter given to my fiancée. It just stated a visa couldn't be given to him at this time because no decision could be made. But I'm tryna make plans to go to Gh and marry my fiancée by August.Another thing is I have been accepted into a nursing program and I start in August , do you think it's gonna affect my application as I have heard in the past that some student can't file for husbands when you receiving loans from the state

Did you enter the case number on the NOA you first received when approved by USCIS ? It starts with 3 letters, not the NVC number.

It won't make any difference as long as you have a steady job meeting the 125% poverty line guidelines. If you don't then you won't get approved

unless you have a joint sponsor.

No I did put the case ID number given to my fiancée. That's how I did the first time and it showed it was in AP but no I didn't put the USCIS no. And yes I do have a steady job,and will still be above the poverty line even if I did full time sch

Ebunulowa I did put the NOA given to me in the USCIS case tracker but it just says my application had been pushed for visa processing. That was in March when my application was sent to the NVC. How long does it take for the U.S. to return an application back to the states? I checked the CEAC website and it still says AP. My fiancée went for the interview on the 8th of June and it does says last day updated was the 8th of June . Do u think it should ve shown refuse or something else? It still says AP. Pls kindly let me know what u think. And this is to all VJ family who can throw more light on it

I have yet to come across a case where they said they were sending it back but had other intent.

I think somebody who naturalised once mentioned that if he looked up his current status it still showed AP.

I would use that as a guide but certainly not 100% accurate.

By what you said your case has been returned. You were advised to do a senatorial inquiry to verify the location of your petition which

you did.

Just because the status continues to read AP means nothing. Sometimes it never changes and sometimes it does.

Mine changed to USCIS received petition but as I said for many it doesn't change.

Do not focus on an update but wait until the inquiry confirms the location and then you will know if it is in AP (still at the embassy)

or at USCIS where it will expire without review and administratively closed.

CEAC will likely not have any new updates. USCIS site may or may not (only with your service center number not the NVC number)after several months.

Follow the diplomatic pouch number to track that your senator's aid may or may not be able to give you.

Thx, I did fax the letter to the senator but I havnt heard anything from them yet, am gonna follow up with a call tomorrow .

Thx Boiler, I do appreciate. As anyone heard about the visa coach, we swears he knows his stuff and has helped a lot of people overcome their fight in this journey. I was surfing the Internet and I came across him. His name is Fred wahl and his gonna charge me $1250 for refilling of the k1 visa. Mad anyone heard abt him. I'm very confused as the first lawyer charged me abt the same price u know

What were the reasons you were denied first time of k1

A bit of advise you still have a 50/50 with refilling a k1 I would think about that before paying the visa coach, and whatever you do with immigration stays in your records whether it's tommorow or ten years from now, so if you refile a k1 the consular will see everything from this visa, it's best to marry and go forward from there

@ joy,the reasons I don't know yet, but o know he answered one question wrongly the consular officer says he sees a relationship going on but he's not convinced we were engaged.
