The processing time difference between Texas and California is killing me....

Nothing in the process in unfair, because the basic requirements are the same for everyone during the filing stage, regardless of gender or country of origin. The speed of approvals changes all the time. During my time, Texas was faster than California, and now its the other way around. I have no idea where you are getting "discrimination" from all this. No rights are being stepped on because bringing your fiance(e) over to the States is not a right, it's a privilege. No one is being tortured or abused here so I have no idea why you are crying human rights violation.

I guess this topic for ppl,who want to find opportunities and loopholes. But tgank u for your opinion.

Hey everyone. So my NOA1 date is Feb. 27th and due to living in Florida my packet is currently in a box collecting dust in Texas.

I know I have a few more months to wait, which I have come to accept as just part of this process. However, the thing that bothers me most is the difference in processing times between Texas and Cali. I mean, SERIOUSLY?! One month NOA2 dates in California vs. 6-8 month NOA2 dates in Texas. It is absolutely ridiculous!

People's lives are at a stand-still for too long as they wait for a simple text from USCIS. There has to be a way for all of us at the TCS who are forced to wait a painfully long time to get together and make change happen. I mean, can't we do something?? Don't we have rights as US citizens to protect us of this injustice, cause honestly it IS injustice. People who sent their package in April are about to have their fiancé's with them in the US whereas people who sent it in November of last year (a 6 month difference!) are still suffering and waiting. What can we do to make change happen???

Some have been working on that for a while now. See the link in my signature. The President is very aware of the problem and based on being notified of it, this is exactly why all current K1 applications since late March are now being directly routed to CSC. Unfortunately, all those who were previously stuck at TSC before that date are still stuck at TSC. It remains to be seen what this new directive will solve, whether it will increase waiting times at CSC to ''balance the workload'', or how long it will last for. Since this directive, I do feel that TSC seems to be working on cases all over the map and in broader chunks, but I don't feel it's sped up much. I think it may have caused some people at the center to scramble but not budge too much.

You cannot begrudge someone for happening to be sent to CSC and being able to be with their loved ones before you. It's not their fault. It's the system. TSC wasn't always slow, but it's clear there is a problem that is a mystery to most of us about exactly what goes on down there. A lot of it, I feel is either a completely bad organizational office policy, mismanagement perhaps, staffing, and an inefficient system that needs reforms entirely. But as you well know in our government that is something no one is willing to change. There are many elected officials that are aware of the problem too, but when it comes down to it, the USCIS is not a taxpayer funded agency, and the only person who can get them to move their butts, is the highest office in the land.

Keep in mind the US doesn't operate at the same policy as, say EU countries under the EUHRC. There is no right to 'family life' or 'freedom of movement' clause in our Constitution. We have the right to life, liberty, and happiness -- but immigration doesn't fall into these categories. States provide us with the right to be legally wed but they cannot provide the right of an immigrant to come here. Immigrating is considered a privilege and not a right, and thus the burden of allowing an immigrant in, must come from the federal system (which is quite broken) through an extra system that is not even a part of any Constitutionally protected due process either. We all have to get in the line and wait our time whether it be fair or not. It would additionally be hard to prove that the problem relates to immigrant discrimination at a service center - and I'm not convinced that's the cause of the trouble either.

I think your priority date equalizes things at the NVC level.. somewhat.. I think?!

Possibly for IR/CR1 petitions. I honestly don't know. But for K1, I was looking at our embassy and the number of days between filing and interview and for CSC filers it's around 100-120 days. For TSC it's just below or in many cases over the 300 day mark.

The difference is that K1 applications are not processed at NVC, unlike the CR1. They are assigned a case number and then sent out swiftly and the embassy takes over.

The only slight different here, seems to be in operational policy at CSC vs TSC. TSC tends to send the files out immediately to NVC as they are processed and completed. But CSC hangs on to them a while, possibly waiting until a giant bin is filled and shipped out to the NVC. This means there can be a larger delay from CSC to NVC, but ultimately usually no more than a month or so in some cases. Meanwhile in that time, a TSCer will still be waiting for months on end untouched to begin with.

Not always. Some are plucked out of the queue for AP. We were there 2 months on our K1.

I don't know how long your visa takes but I was referring specifically to the K1 Fiance visa where there are dozens of reports on this website of cases in Cali from April currently being processed versus mainly October cases in Texas.

There are some people that filed after me and already got their NOA2 even though were all being processed in the same processing center. What gives? are there really some loopholes or tricks to speedup the process?

i dont knowww i am truly losing my mind, i am too feb filler , i am dying being away from my fiance, i feel like i am in a cage no exit , i am even will try with visitor visa though i know it is soooooooooooo difficult to have, but anything to raise my hope that i will be with him soon

They don't care about being fair. It's all about the statistics on paper. Sad, but true

i dont knowww i am truly losing my mind, i am too feb filler , i am dying being away from my fiance, i feel like i am in a cage no exit , i am even will try with visitor visa though i know it is soooooooooooo difficult to have, but anything to raise my hope that i will be with him soon

Are you able to try for a visitor visa? The visits really help. I can't see your country from my phone while posting so I don't know what your chances are. We are very thankful that we were able to visit during the process. Many can't and I cannot imagine what they must have gone through. Focus on your sweetheart. Together you can do this. It's so hard, but you do get to the end. Eventually (F)

i know my chance to hav this visa the visitor soooooooooooooooo slim

i know that it is near to impossible, he has a work and already finished all his vacation on his last visit to me, if i cant take the visitor or tourism visa, then we will not see each other until i have my k1 visa and this is to me soo painful , i cant bear the waiting anymore, though i am and will wait, its worth because i deeply love him, but truly so painful , i wish i can do something, knowing that my approval still in September and dont know maybe will be even after that with whats happening with the TSC nightmare, its killing me, i wish they even cam make visitor visas to the TSC fillers to be easier for them because of the waiting time, anything, i dont know , i will try , just try
