denied k1 waiting on noa 2 for cr1 supporting docs

Hey guys so I had a k1 visa denied got married in Jan this year and filed cr1 got my noa 1 just waiting on approval my question is I just Sent my marríage cert a copy of the letter they gave me a y the embassy the 221g and pics of my passport with my stamps Would that be enough evidence for uscis

The bigger issue is this, what was the reason given by the Embassy as to why the K1 was denied? Getting married may not overcome those issues, even if USCIS were to approve this petition, it still faces a higher hurdle at the Embassy.

You have to overcome the reason of denial.

Then you have to submit evidence of a bona fide marriage.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Here are my answers regarding your evidence list:

  • Marriage certificate: required submission, does not speak to genuineness of relationship
  • Copy of 221g letter: worthless
  • Pictures of passport stamps: I want to make sure I understand you correctly here. Did you take a pictures of your passport pages with the stamps or did you copy the pages of your passport with the stamps and submit the copies? Please clarify. Regardless of how did this, it's only useful if there is another piece of evidence indicating travel and that it was in fact you that traveled (e.g. a boarding pass).

This is a very light list, especially for a known high-fraud country. It may be enough for a USCIS approval but it may not be enough for approval of a visa. Since the file would go to the NVC, you will have the opportunity to include more evidence. The best evidence is that of time spent together in person.

After the file is sent back, USCIS simply lets the petition expire and they tell the petitioner that they are free to start over at square one. Unlike fiance(e) visa petitions, spousal visa petitions don't carry an expiration date so if a spousal visa is denied, USCIS must act on it when they receive it back.

Yes that I know that why I just went straight to cr1 petition People here dont know they Hardly give the reason of denial all they say is start over or get married

If you made a copy of all pages of your passport, then not having the boarding passes is no issue since travel can be attributed to you.

The problem with saving items for the interview is a CO may never ask to see it and could immediately pass it back without so much as a glance if you tried passing it to them.

The NVC does not ask for nor require any relationship evidence. Some people use this step to place things into the file for a CO to see in case they forgot to put it in with the initial petition submission. Often the case, a denial on the basis of "not a bona fide relationship" is made on the predication that USCIS was not aware of certain facts when the petition was submitted and would not have otherwise approved the petition. Submitting all evidence at the outset does not guarantee that a visa will be issued but does guarantee that it will be part of a the file that a CO will look at prior to an interview taking place.

I agree and understand 100% because I went through it.

My statement was he has to overcome the hurdle that stopped him the first time, whatever was checked on his 221g,

likely ' for immigration benefits only'. Getting married usually overcomes this but not always so he knows what was said at the interview and what his

red flags are or were.

His evidence he mentioned is definitely too light and I would side load at NVC.

Ok so you guys suggesting to put more evidence at the nvc stage so when the co for my interview see it he or she Would get a better look at my case im the wife usc husband is in Dominican Repúblic

Just a suggestion, but if your spouse is the beneficiary on any of your financial accounts, why not provide documented proof of that? That should be strong evidence.

My wife is the beneficiary on all my bank, retirement and investment accounts. That and a copy of you Will should be powerful evidence of a legitimate marriage.

I just feel that the refusal of the K-1 (though it is not supposed to) is going to cause you problems.

Your evidence better be good.,.,.after a refusal. I really do not think I read a specific reason for the 221g, denial.
