Lost green card after filing I-751 and received NOA

Hey everyone

I have just lost my 2-yr conditional green card. It expires at the end of next month (April), and I have already filed my I-751 to remove conditions and have received my NOA. I am traveling overseas in 3 weeks (the week before my lost green card would have expired).

  • Having just paid the $590 for the 10-yr greencard and assuming I'm doing biometrics for that in the next month or two, do I now also have to submit a $450 I-90 (green card replacement) as well? It seems like a strange result, as I would have biometrics for the replacement expired card most likely after the biometrics for my new 10 year greencard. It looks like a replacement card can take over 4 months to receive.
  • In this scenario, can I get an Infopass appointment to get an I-551 stamp without submitting a receipt for submitting the Form I-90 (replacement green card)? Perhaps by submitting my NOA Receipt Notice for the I-751?
  • And can anyone confirm what I need in order to travel overseas without my lost green card (expired or not expired) before a replacement is given to me. Would I need (i) an I-551 stamp, (ii) my NOA (I-751 Receipt Notice), (iii) a police report for the lost card???

For those looking at my timeline, I believe why mine took 6 months was partly due to Hurricane Sandy in NYC causing delays in interview scheduling.

04/30/15 - Conditional Green Card will expire

Make an Infopass appointment at your local office, taking your valid foreign passport and your I-751 NOA and ask for an I-551 stamp. They may or may not give you one, because you don't have your original green card any longer. They may require you to file an I-90 before they'll give you a stamp.

Really appreciate the reply Hypnos. The question of whether they may require me to file the I-90 before they give me a stamp is the key question. Could they even issue me a "replacement" green card under this timeline using an I-90 if my conditional green card would have expired? For instance, if in 4 months time I got a replacement green card in the mail, wouldn't it still be a replacement of my 2-yr conditional green card which would have expired 3 month earlier?

I'm trying to figure this out without having to make two Infopass appointments (ie, a second one if they don't give me a stamp without the I-90) because my local office (NYC) only has appointments in 2 weeks time, and I need to leave the country in 3 weeks, so I won't be able to have two appointment by then.

Yes it would be a replacement of your old conditional green card, but that plus your I-751 NOA / extension letter will be enough to get you back into the country.

It's really going to depend upon how flexible your local office is going to be. They may give you a stamp without an I-90 filing or they may not.

OH this stinks! I'm sorry you have to deal with this. I'm curious to see how it is handled. I got my passport stamped but i had to hand in the green cards (me and kids) in order to do so. I would certainly think you need to submit for the card replacement. The 10 year card is going to take quite some time to get to be complete and in your hands.

Do you still have a VALID Australian passport? You'd be able to go THERE with it but how can you get back into America without a stamp in it? Can you book yourself two appointments? I don't know if it lets you do that but what if you book two appointments back to back in case they don't let you get the stamp?

You have photocopies of your green card to present. What if you take that, you take the application for the replacement with you and the check. Tell them you'll submit it immediately if you have to but you need to travel and can they please stamp your passport?

I don't know! Grasping at ideas for you.

I actually ended up finding my Green Card!! So I never ended up having to go to an infopass appointment, so I can't tell you what would have happened unfortunately... I'm so sorry to hear you are in a similar position; it is really frustrating! I would book an infopass appointment asap (you can always cancel it if the card turns up). Good luck!

I-551 stamp in your current valid foreigh passport does work. Go in with a very neat looking appearance, but do not over dress. Be very polite, show what paper work you do have, very politely explain your situation. If you get negative results, request to see a supervisor. Never get angry, only hurting yourself. May help to have your spouse with you.

My wife at this stage would get very nervous and even braindead with all those guards carrying side arms. And the ROC is kind of a joint application, and she is my family kind of thing.
