Hi VJ Friends,

So, my father took my package to the states for him to deliver it out. But before hand, he asked me if it was ok for him to take it to an agency to review to make sure everything is good, which I am SOOO glad he did.

They found few mistakes, which I guess, under stress, I didn't notice but the lady at the agency stated I am missing my husband's birth certificate. I told her is not needed in the beginning of the process but she stated otherwise.

Question is:

Is my Husband's Birth Certificate is needed with the I-130 Package?

Would it hurt for me to include it?

Yeah you dont need it now but for nvc yeah but only the copy the original is needed for the interview good luck i Just sent the papers now but i sent his bc just in case

If you have the birth certificate, send a copy. Doesn't hurt. Dealing with the USCIS is time consuming enough, why invite delays if you already have the evidence. Keep all originals for the interview. Who is the USC petitioner.. husband or wife?

You seem to be getting a variety of responses from people and I don't want to add to the confusion BUT can you clarify please. Is this the petition from your husband? If he is filing the I-130 as a US citizen petitioning his wife then, yes, he is supposed to prove that he is allowed to petition for you. Most people use their birth certificate as this proof but you can also use a passport or naturalization documents. Please refer to this link which is the instructions for the I-130 http://www.uscis.gov/sites/default/files/files/form/i-130instr.pdf

Page 2, top right side regarding what documents are needed to prove the petitioner is a citizen. So unless other documents were submitted instead, the birth certificate copy is needed. Unless of course the instructions have changed but these are the most recent ones that are posted on the USCIS site. Someone can correct me if I'm mistaken. But I always say give them everything they ask for and don't leave anything out. That's the part we have control of in this process. Make it easy for the person on the other end who is receiving your file!

I can't edit my post but want to be clear... your husband's birth certificate is only needed if HE is the petitioner. That's why I asked. If he is the beneficiary then only yours is needed if that's what YOU are using to prove your eligibility to petition him.

No you do not need to send a copy of the beneficiary's birth certificate or a petitioner's foreign birth certificate.
