Only submitted i-129F form to Texas Service Center

Hi,

I made a mistake and only sent the i-129F form to the Texas Center. This means that I did not send a check or any additional forms/photos.

I called the center, and they said that I should wait to get my receipt number before sending additional documents. However, I'm worried because I didn't even submit a check. Will they deny my application instead of sending me a RFE? If my application gets denied, is there an additional form I need to complete (a waiver or something) before sending my complete packet? Are my chances of getting approved diminished because of this?

just relax. they are going to send you all the documents back so that you can send them with the check. I suggest reading the guides and checking with everyone here before sending off your packet again. by rushing you will end up wasting more time.

Very likely, they will return the petition as invalid for missing the check. Then you just file again.

Spend a few more days ensuring your filing is comprehensive and complete. Do not try to shortcut. By spending a few more days making filing complete, you can hopefully avoiding RFE, which otherwise just adds several more weeks of waiting. What I learned after filing several different petitions with the USCIS for myself and my fiancee, by ensuring the initial packet is complete, things tend to go much smoother throughout the entire process.

Ok. Yeah, I actually thought I researched this extensively before applying, but I should have consulted the forum to know that you have to send everything as a packet.

It's actually pretty confusing if you don't search elsewhere. I looked at this:

• You, the U.S. citizen sponsor, must file Form I-129F, Petition for Alien Fiancé(e), with the USCIS office that serves the area where you live. See Direct Filing Addresses for Form I-129F, Petition for Alien Fiancé(e) for information on where to file the petition. Further information is available on the USCIS website under Fiancé(e) Visas. Note: Form I-129F cannot be filed at a U.S. Embassy, Consulate, or USCIS office abroad.
• After USCIS approves the petition, it is sent to the National Visa Center (NVC). The NVC will give you a case number and send your petition to the U.S. Embassy or Consulate where your fiancé(e) lives.

Based on what this says, I thought I would have to just fill out the form, send it in, and wait to send everything else.

Ok, so based on what everyone is saying, is there a difference between an application being invalid and one being outright denied? Once I get the forms sent back, do I just have to assemble my package and resubmit? Or is there an extra process I need to go through because I messed up the first time?

No, if they return it to you it just hasn't been accepted for processing due to invalid filing. You start over and that's it.

I'm not sure if they send it back to you! You may have to send it again!

They will reject it without a fee. File again with the fee and all the required documentation. You need to read the I-129F forum instructions. The download link is right under the link to the form. The instructions tell you what is required to send. http://www.uscis.gov/i-129f

Also, you do not send it to the Texas Service Center. All petitions are mailed to the Dallas Lockbox intake facility and from there are sorted and sent to either the California or Texas Service Center.

I also think the USCIS website is absolutely awful. They link to the electronic notification form, and they state that it can only be sent to certain lockbock facilities, but dallas isn't even listed there...

The instructions state that it can be filed with applications that are sent to a lockbox facility. It doesn't say only certain lockboxes. Where did you see that?

Right, but that's because the Dallas address technically isn't a lockbox facility. That's why they can receive packages that require delivery confirmation -- because there's someone there to sign for it, since it's not a lockbox. The Lewisville address is a lockbox.

But I agree that it could be confusing for someone who hasn't researched the difference between the two. That's why VJ exists!
