Well then I would also start bugging your lawyer given that you likely pay him a lot for money for something that is basically just glorified paper work.

I would still make my own enquiries to - no one can stop you doing it.

yeah I talked to my fiancé and we are going to starting bugging Monday... like I expected this to all be done by now.. it never crossed my mind getting a denial considering we have so much evidence and I have been there sooooo much .. usually every 9 days... and the longest we have ever been apart is 3 weeks .

You are not going to get denied. It is likely a bullshit admin error. It happens. Unfortunately.

You do have the patient of a saint, I would have started climbing the walls round about August last year...

awww thanks... yeah I think the only reason we have managed is cause I am there so often. if it wasn't for that I wouldn't manage... and thank god it is cheaper to fly to texas then anywhere in Canada! thanks for making me feel better on the matter :)

so how me and my fiancé met on match.com... all I did was look on his page and he sent me a message ... and we started talking and realized we were both from Canada let alone a province of 900,000 people and that I was related to the best man in his sisters wedding and he grew up with one of my ex's ( small world) this was in july 2013... that july I went down to texas for the first time to meet him... and I work on a oil site.. so I work rotational,... so it give me the opportunity to go back and fourth.. he then came up to Canada to meet my family in dec 2013 and at that point we knew we wanted to get married to we talked to our lawyer then.. and he hadn't brought me a ring yet.. but we knew we wanted to get married and he still wanted it to kinda be a surprise.. so we applied for the k1 in march.. he gave me the ring june 5th 2014 the day we moved into our new house. my fiancé is a dual citizen and its because he married an American in 2003 and had a son with her and then he filed for divorce in 2008 and at that point he had his naturalization ... he sponsored his parents a year ago.. so I wasn't sure if that may have had something to do with it.

Hmmm....so he got his US citiitzenship through his ex-wife? Who probably petitioned on his behalf way back in the day?

That might raise a red flag for USCIS. It is not an issue obviously as long as the divorce is finalized and his naturalization is through and provable, but might explain the longer than usual processing times.

I reiterate: Get on the phone and bug USCIS - nothing in your story seems problematic...just some background issues that might be slowing you down.

yeah that's what I was thinking.. yes the divorce was finalized in 2008 and we sent in his naturalization documents and divorce decree.. and his ex is already re married ( I have met her and her new husband).

i think it's a red flag also, but not that big of one.

what they probably did is to pull his A-File, or request to pull his A-File, out of storage, and that takes some time.

When you talk to an ISO (the petitioner must do this, not you) - what's the status of the case and RFE review?

I would just suggest waiting a little longer on K-1, until you can find out the problem. Maybe you might have to go the I-130, if so it just starts a year over, when, we can only hope this be cleared up in a few weeks.

Good luck to you on what ever you choose, you sound very devoted to each other, and are meant to be together!

Have you used a lawyer for the entire process, from the time of filing? Are you sure he has filed everything you have given to him?

we sent in a copy of my engagement ring and our wedding bands .. copy of communication with booking our venue... convo's between me and his mom and me and him regarding the wedding.. pics of my parents coming down to visit over the summer.

yes we have used a lawyer from start to finish.... and he is the same one his parents used.. my fiancé used to become legal and his brother... and they seemed to have no issues. I never have trouble when crossing twice a month.. they never even ask when I am coming back.. they usually just stamp my passport to stay for the 6 months.

Hey Everyone,

so my fiancé filed his petition march 2014 and we received a RFE Dec 16th request proof we were going to get married within 90 days of my entry.. so we sent all the information back and they sent us a email saying they received it jan 2nd.. everyones time timeline I look at gets a reply in 1- 2 weeks... I have no clue what is taking so long... I visit my fiancé 2 times a month and we have more then enough proof... my family has even been down to meet his family and we own a house together and everything... this is starting to get too frustrating.. and the thing is we are both Canadian, so I am debating having him come back to Canada and just get married... like I assumed everything would be done by now...

anyone have any advice!!??

We too have a simular case. I'm American marrying a Canadian. We filed June 9th, 2014, I-129f. Received RFE Dec 20th 2014. We did not use a lawyer. Unfortunately, I left out the G-325-A form from both of us & I needed to send those forms and photos of us. We also included a letter from each of us, intent to marry within 90 days. They text reply that they received it and the letter came saying to wait till Feb 28th, 2015. We too, do not understand why it is taking so long. Originally, I sent everything I had about myself, including passport, ss, bank statements, pictures of us, email conversations, etc. and also same for my fiance. We are in our 50's, been married before & divorce, of course. Maybe I sent too much info, and yet I left out an important form. So, they have this info now.

I have made an appointment to visit homeland security in person Feb 19th. Everytime I call, I get the same answer, that I need to wait for the letter of approval. (Not what I wanted to hear).

We knew it would take about 6 mths, but didn't expect it to be 8 mtns later, and still have not received NOA2.

What is frustrating to me is that I get emails everyday from others who have the same timeline as us, from other countries. I'm happy for them that they are already in the US and some married.

We would like to hear from other people, especially if you are a US/CAN couple, if you have experienced this long delay and why.
