I applied for I-129F (Fiance visa) on October 30th 2014, I was told it takes around 5 months. My fiancé and I got married overseas on November 21st. During one of my visits overseas I applied for a B1 visa for my wife (I wanted to "Bypass" her entry to the USA). She went to the embassy for an interview and showed that we are married and she just wants to visit me, her visa was approved and her passport got stamped with a 3 months B1 visa (Until April 14th, 2015).

She entered the USA and was given a 6 months I-94 (Until July 22nd), even though her visa on the passport indicated it's good for 3 months only , so she's with me now.

So, what should I do now? Get married again here and ignore the original I-129F petition and apply for a I-485? Or should I apply for a different status! Thanks for help in advance, I appreciate it.

If you are married, the fiancé visa is now null and void. You must apply for something different now that you are married. A marriage is a marriage, regardless of where the wedding took place.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

This is good news about the B-1 visa.. In 3 weeks my wife is comming into New Jersey for 5 1/2 months .. we have a CR-1 in process now at TSC where there are major

delays..If we get notified of an approval and it gets through and it is before her return date.. I will have to change her return ticket immediately to get her back for the police

check and medical...Her B-1 is for 10 years.. she got it in November 2013 and never used it yet so I expect CBP to not give her a problem at POE as she will have a copy of the NOA-1 showing we are doing everything by the book.. TO ANSWER YOUR QUESTION......Now you must file the CR-1 visa...... known as the I-130 petition... You will need to start over as you are NOW married and the I-129 is now no longer good... ............Good Luck to you.......Congrats on the Marriage...

Did your wife had a B-1 visa before you even applied for CR-1? Was she issued B-1 for business purpose?

She had it for a year before I filed the CR-1..... She is in the Colombian Military and got it through them...

You cant marry her again. You need to cancel the I-129 and start over with the CR process.

Absolutely. The only thing you need to bear in mind is that if you go for AOS she won't be able to return home for the next 3-4 months, until she receives her AP.
