hi! I red some of the post here in VJ that they did not make it thru their medical exams.. They say using illegal drugs might cause you denied application even if that was along time ago. plus having a PTB in your x-rays might cause your delay in your interview date. I was just thinking what are the other things could ruin or delay your process in the interview... Like having a HIV or STD? or having done an abortion might failed you on your medical exams..

Having an abortion is legal and will definitely not have you fail a medical exam. As far as I know, the US recently changed their policy on HIV and this no longer have an effect on the application.

VOL, the OP is immigrating to the US and in the US, and the rest of the civilised world, abortion is not a crime. The US government does not deny a visa application because someone has had an abortion.

OP, the medical examination in the Philippines is done by St Luke's Medical Center, which was established to work with visa immigrants to the US and later on to other countries as well. They are the sole accredited medical facility to conduct medical examinations for US visa immigration purposes and have been approved by both the CDC and the US State Department as following human rights and US customs. As part of the medical examination, you are to mention any pregnancies AND deliveries. If you had a pregnancy that did not end up with a delivery, for whatever reason, you don't need to mention that. If you are still worried about this, send me a message and I'll be happy to contact the US embassy in Manila and check on this using my name.

We are not dealing with Philippine law here. The Philippine government has no jurisdiction over the US embassy, therefore Philippine laws do not apply. Only US laws apply within the property of the US embassy.

No, you cannot be banned for abortion, because as was previously stated it is not illegal here in the US.

Confused here, So if she had abortion you do not need to mention to SLEC? I believe this is bad information to tell someone.

I'm not from the Philippines but as the above poster stated, abortion is NOT A CRIME in the US, the medical she's getting done is for the USA so the laws in the Philippines are irrelevant - UNLESS it's also a crime in the US.

Again you are referring to Philippine law.

I am not disagreeing with you in regards to what is legal or not legal there. I am disagreeing with you because you don't understand the concept of US sovereignty within the US embassy.

You see, when you are at the US embassy, you are on US soil. You are not in the Philippines anymore. Philippine laws do not apply at the US embassy, only US laws.

Besides, I don't think the doctor that is performing medical exam for the purpose of

US visa processing is after determining whether you had an abortion, as its a non-issue in US.

But TB and hard core drug use could be a different story.

I think VOL has a point here. It's a crime in the Philippines. Period. Full Stop. The question they ask is have you (the applicant) committed a crime, whether arrested, prosecuted, convicted or not. Read the DS-160 again carefully. Its questions are worded so that any crime, anywhere committed must be disclosed. Why not just say you miscarried?
