K1 Refused

Our Ceac changed from AP to Refused. What do we do now? It has been almost 2 years! How are we supposed to just start over? I never thought we'd get denied. I don't even know what to do. . .

So sorry to hear this, do you know why you were refused? Have you considered getting married and going the CR-1 route?

we think it's because the medical came late. the doctor didn't deliver it before the interview. that's what he was told at the interview. I'll have to start a new petition.

When you say that case changed from ap to refuse , and that has been 2 years,

People can think that you have 2 years in ap, and the interview was on january 15 so the case doesnt have 2 years in ap.

time in ap doesnt count from the day that you started the petition.

& they sent their petition 2014-06-07 so it hasn't even been one year yet.

We attempted to get married and do a CR-1 before the K1 but we missed our flight and had to cancel our wedding plans since the next flight out out was the day after we returned from our honeymoon. We have been trying to get married for almost 2 years.

You should try to find out what the reason for the refusal was. You need to overcome this, lest you may face the same refusal for CR-1.

You could try contacting an immigration lawyer specializing in denied petitions.

Were there any red flags in your petition/at interview? Age gap, not having met (often or long enough) - I am not saying this is in any way shape or form true, but anything a consular officer might find strange and question the bona fide relationship?

Is Morroco a tough consulate to get approval?

A late medical would not cause a flat out refusal - you'd be refused at the interview, pending delivery of the medical results. Did your fiance get his passport back?

It feels strange that a late medical would be the reason for a refusal, they would just wait for it. Could it have been because of something in the medical exam that caused him a refusal?

I had read your question and see a lot of replies. They are helpful but none answer your question and thus, it cannot be answered. Not even I can. In this case: You need Not seek legal advise at this time. You need to go directly to the source. That is a Infopass appointment to see what you are up against. That would be my advice and your attention should be quick on the matter. Your answer will be found there. not here/guess work is not what you need.

We have been together for 3 years. I have been to morocco dozens of times. No flags, he's one year older than me, speaks fluent english, and we submitted lots of pictures letters and plane stubs. Interview went well until the CO said the medical had not arrived. He gave him his passport back and the VAWA pamphlet. He was told the embassy would contact him when the medical arrived. When he spoke with the doctor, the doctor said he delivered the medical two days after the interview. Our status changes this evening to refused. CEAC said to read the paper given at the interview for the reason for denial which was missing documents - the reason we were in AP to begin with.

So, it sounds like missing Medicals. Is that your conclusion. That seems like a AP issue. Not a denial.

I guess isnt a deniel perse, maybe the status say refuse until they work with the medical.

I have red about people here that their status says refuse on ceac but it isnt a denial it is because they are working on their file.

So be patient, i have seen here too that when a petition is revoke the status on ceac is denied no refuse.

So be patient and wait this week and see what happen.
