Would conditions be removed at Port of Entry

Hi Everyone,

My CR1 was approved on 27th November 2014 and our second Anniversary is on 10th of March 2015.I am planning to fly down on April 1,2015 to the States.Would we have to apply for removal of conditions or would the CR1 be converted to an IR1 at the Port of Entry. ??

It will convert to an IR1 if you enter after your 2nd anniversary.10 years green card.

OP, what you will need to do is inform the CBP officer that you have been married for over two years (be prepared to show the marriage certificate).

Mine was automatically stamped IR1 no questions asked. I entered a month after our anniversary

They aren't removing conditions. They are completing the process based on what you present them upon entry. Because it is after the 2 year anniversary you would be granted IR1 (10 years) instead of CR1 (2 year) green card. As Ryan H mentioned, be sure to have your marriage certificate with you so you can prove the date being more than 2 years ago. Take a moment to politely let them know that you have been married more than 2 years so they don't miss it.

I'm very confused and I could be very wrong. I thought that if you were married for 3 years when applying for residence, for example, you would be granted IR1. But if you were married for just a few months (CR1), and you would remove conditions 2 years after you become a Permanent resident and not on your anniversary.

I don't think your explanation makes much sense because CR1s would just travel on their anniversary date, saving time and money since they'd "remove their conditions" upon entering.

I don't think your explanation makes much sense because CR1s would just travel on their anniversary date, saving time and money since they'd "remove their conditions" upon entering.

If you are married for 2 years or more on the day you complete your POE you will be granted IR1.

If you are married for less than 2 years on the day you complete your POE you will be granted a conditional green card CR1.

Those of us who have a CR1 must remove our conditions of our green card two years after our POE. It is not based on our wedding anniversary but based on the two year anniversary of having been granted our status at POE.

I am not sure how better to explain it but my explanation in terms of the timing is correct.

Maybe you have 3 years in your mind because if we are married we can apply for citizenship after 3 years of being a resident??

You have it wrong.

Married for 2 years, then IR-1. No ROC needed.

Married less than 2 years, then CR-1. ROC needed upon 2nd anniversary of getting the green card which is automatic upon entry.

However, a CR-1 who enters the U.S. after 2 years of marriage is treated like a IR-1. This person does not need ROC.

So it makes complete sense for CR-1 visa holders to time their entry after their 2nd marriage anniversary since they can avoid the wasted time and money of a ROC.

You are not understanding the rules correctly. There is also no such thing as "removing condition" upon entry.
