Timeline

Hi, just wondering how my husband goes about putting my son and I on his tax this year, does he do it from the date that we entered the country or from the date we got married?

Any insight into this would be greatly appreciated thank you!!

I could be wrong, but it will be from the time your Husband started supporting you, whether it was from the time you enter the country or from the time you was married

If you were married even one day during 2014 you can file jointly with him for the entire year, even if you did not even step foot in the US.

If you were married even one day during 2014 you can file jointly with him for the entire year, even if you did not even step foot in the US.

Adding on to this excellent answer.

It's not any one day in 2014.

Marital status for any tax year is determined by the taxpayers' status on December 31.

If the OP was married on Dec. 31, 2014, then she can file a joint return with her USC husband, and they can claim her son as a dependent.

SSNs for mom and son are required for the tax return. Living in the US is not.

I could be wrong but I thought if you are married and your spouse lives in another country you has to file married filing seperate

A nonresident alien spouse can elect to be treated as a U.S. taxpayer and file a joint return with the US spouse.

You were married in 2014 and can file a joint tax return with your wife for 2014. It is pretty complicated to get her itin because it requires her actual passport. You can look it up because there are some ways abroad and I haven't looked at it since last year. Mostly complicated to try to get it without sending off the passport. So you can just do an amended return to change your filing status as soon as she gets here and has a SSN. Then you will get some money back.

The kicker for filing jointly is worldwide income must be reported. If she works in the Philippines then her wages will be reported (converted to US dollars). But there is a foreign income exclusion (Form 2555EZ) so the tax her income might generate will be subtracted before your bottom line. Do your taxes married filing separately. Then do them again married filing jointly with the foreign income exclusion and take a look at the difference. If she didn't work in 2014, then even easier. Adding a wife can reduce your taxable income for 2014 by $10,150. That will make a difference in your taxes. Plus married separately pays a higher rate on the same amount of income than a joint return.

I will probably have to have a tax company do my taxes. I usually do them myself but this seem a little harder. I got in trouble with Irs once before a while back. I do not want that again Edited by j&ana
