EAD still in Case was Received status since October, 31.

Hi,

I sent my application on the 31th of October. i also filed for EAD and AP.

I had my biometrics on the 23th of November.

When checking my status on the USCIS website, it says that I am waiting to get my AOS interview since 1st of December.

I called USCIS to know about the processing time, as they were advising me to call if I didn't get my interview notice by the 31st of December. I got told that

it could be over 4 months to wait as my area was really busy with applications (Southern California).

I understand that completely but I am now wondering about my EAD.

My case is still in 'Case was received' situation since November, it never changed.

I received a job offer that I cannot accept for now, and the company is willing to wait a little, but I would lose a nice opportunity if

it takes too long to get my EAD. I have heard of expedite processing for EAD but don't know if I can really apply to it.

I am also worried about getting an actual RFE as I have seen people receiving RFE after 75 days of filing their applications.

Anybody applied for expedite processing of their EAD or the fact I am still in the 60-90 days period of filing will get me denied?

I have called USCIS to file service request due to my application pending more than 75 days. I got approved the next day or so. I remember many people did too.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Talk to your congressperson. I expedited my EAD successfully based on a job offer. Mine was approved within hours after I spoke to my congressman's office.

You need to demonstrate some sort of financial hardship, but all I said in this regard was that my husband had been unable to secure a full time position and was working a contract role that could be terminated at any time (this was true). There's no guarantee, but there's also no harm in trying.

Where do I find the phone number? Sent my husband's AOS on November 4th and we are desperate to get his EAD. He REALLY wants to work to get our lives moving forward. I will try anything to get this work permit faster!

Do I count from the day we sent the album or the day we received the confirmation letters that they received our album?

Go to USCIS and enter your receipt number to check your status, it should say the date and use that date to count 75 days.

Thanks for all the information.

I am still under the 75 days period so I will wait a little bit more. My wife has a full-time position, so extreme financial hardship doesn't apply neccessarily. One salary is just tedious for both of us sometimes.

I don't have a congressman or at least, never used anything like that.

You can contact his or her office. They should have a staffer that deals with immigration issues.

My case doesnt even show up in the system. They are experiencing 'technical difficuties' with that site

My hubby's AOS was sent in beginning of Oct (the 6th) and he got his EAD on Dec 27th. So I would guess you will get yours end of this month just going off that timeline. But it is USCIS, so who really knows...

AOS: SEPT 24th, 2015 GREEN CARD RECEIVED !! 

ROC:  Oct 10, 2018    Approval of ROC via online USCIS site.  

Naturalization: March 26th, 2021 Approved!!

As of 2022, we are working towards moving back to Australia likely in 2025.
