Few questions regarding i864:

Sponsor who is filing for mom and wife has filed taxes for 2012,2011,2010, but not 2013. What to write on Part 6, Sponsor income and employment; 13a (most recent year), should i write 2012 as most recent year? or 2013? However, 2013 would be a lie because it says 'adjusted gross income on IRS FORM 1040EZ) which was never filed. This is very tricky, sponsor can file taxes soon or with 2014, however immigration forms needs to be sent this week. Annual income is around 90k, i can include paycheck stubs for 2014 and a letter to explain that taxes were not filed in 2013? if that would help.

Secondly, he's filing for mom and wife separately, on separate visas, so he will not put wife's name on parent's i-864 (part 3) (if parent is the principal immigrant) and vice versa. It seems like the right way to it, i just need confirmation.

8/20/2013 - INTERVIEW SCHEDULED FOR 9/20/2013

 

 

8/21/2012 - Interview Cancelled! ;(

 

 

8/22/2013 - 2nd interview scheduled for 24th September.

 

 

8/27/2013 - Online update - EAD card ordered!

 

 

9/5/2013 - EAD card received

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If this is the only option you have. you could try to use 2012 tax form. I am almost certain you will get a checklist for the 2013 tax year. your sponsor can back-file most likely he will have to pay penalty. It will of been so much better if you will of plan ahead research find out if everything was in order had backup plan in case. This is not something where you are only giving a day notice.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

Should i include pay check stubs for his 2014 income to help the case? Yes, you should include pay stubs AND a letter from his employer stating position, salary, and type of position (i.e. contract, permentant, temporary, etc)

No, 2013 is the most recent tax year. I woould have your sponsor back file their 2013 taxes and get their account up to date. Once the IRS processes the tax return, have this person obtain an IRS tax transcript. Once you have the 2013 tax transcirpt file your AOS package--there is no dead line for filing other than the immigrant spouse cannot travel internationally and re-enter the US nor can they legally work. Once the I-94 expires they will be considered out of status and could be detained if they encounter a CBP person if they get close to one of the borders. Your other option is to file without the 2013 tax return and expect an RFE for it, but by then your co-sponsor should have filed and the IRS processed their 2013 tax return. Other option would be to find another co-sponsor.
