marriage license, what to do for AOS?

Hi, my fiance has arrived in US Nov 14, we are planning to get married Jan 15. We already purchased our marriage license. I was told that once we get married we will have to wait for the final marriage license (typed up and all) 30 days later. Is it ok to send a copy of the marriage license that has the hand written version of the judge who had married us. Because if I wait for that 30 days, my fiance's stay will be expired by (Feb 15). Please advice?

Hi. I believe you actually have to send the official typed-up marriage certificate.

I have read on VJ situations where couples sent their AOS packet after the K-1 expired.

I think what is important is for you two to get married prior to the K-1 expiring.

There should be no problem sending your AOS after the k-1 expires, because you will already be married.

You need a copy of your marriage certificate, not license. Ask about going in person to pick up the marriage certificate. Sometimes you can get it faster that way instead of waiting for it to be mailed to you.

USCIS will want a certified copy of the marriage certificate, so be patient. There is no 90 day "rush" to file AOS.

Do not worry about the 90 days on the I-94 expiring, for the most part that is for getting married, you did that so you are fine. Relax

We had a civil marriage with Justice of Peace,

and we were able to get several certified copies of our marriage certificates

right on the spot.

We also received the original to marriage certificate by mail about 2 weeks later.

In Texas, the marriage licence, once endorsed and stamped by the county, becomes the marriage certificate; there is no separate "marriage certificate" in Texas, and this is also true of a few other states too.

This is the case in FL too. It is not a typical 'certificate-like' document. The stamp and signature, along with the marriage registration info that is printed at the top is what makes it the certificate instead of just the license.

one of the court house representative told me that once I get married the judge will sign my marriage license and then i would have to send that to the clerk, and they will eventually mail me a finalized marraige certificate.

So if my fiance and i married prior to the 90 day deadline, but file the AOS a month later, my fiance won't get deported or anything like that? is there a deadline on when or the latest time you can submit the AOS?

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

Hand deliver your license to the clerk after you marry and ask about getting a copy of the certificate in person. As I said, you might be able to get it faster if you pick it up instead of waiting for it to be mailed.
