Reasons a tier 2 couldn't give us info on our file?

Hey guys,

So me and my fiancé are past normal processing times and when he called and asked to speak to a tier 2 rep.. They told him they couldn't give him any info? That we had to put thru a service request. Now to my understanding .. I thought they could tell if your file was being looked at ? We have a very straight forward case .. So I don't get what's taking so long.

The representative isn't in a place to just make a decision on your case right then and there. That's why you need to submit the service request -- to formally notify USCIS that you're past normal processing times and that they need to address it.

petitioner must talk, ask pointed questions:

1. adjudicator assigned to casefile? yes? no?

2. if yes on 1, as of which date?

3. fbi namechecks completed? yes? no? if yes, on which date?

there's other, focused and pointed questions to ask. I wish the search engine wasn't restricted on duration, you'd find some interesting bits written by me from 2 years ago.

Right, but if you haven't gotten an approval, RFE, or denial, then it hasn't been looked at yet.

For sure the case hasn't been looked at yet, however she was just asking why the Tier 2 couldn't give any info about since they should know better what happened to our cases and if you read better some other posts you will see people who really got to know about their cases talking to a proper Tier 2, especially passing their normal processing time (She's a march filler).

Alicia, I read a lot of posts here and looks like they are really backlogged and sometimes due to it they even refuse to direct your call to a Tier 2 (They get tons of calls a day), BUT maybe they couldn't give you more details due to the system glitches they're facing now. Other than date I don't know why they didn't say anything about it, maybe it has to do with the way your fiancé asked about it (Maybe just a general question) and try to follow Darnell tips.

I don't know if it could help (People have mixed feelings about it) but maybe getting in touch with the US Citizen Congressman could help somehow, at least to know why it is taking so long. I also recommend you to check other posts of people in the same situation to figure out what they did!!! I hope you get to know soon and that your approval is on the way! :)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry to hear that your case takes so long. My fiance was able to speak with tier 2 around 2 weeks ago. Although he didn't provide any detailed information about our case but he was willing to put him through to our case worker unfortunately with no success. I don't think that your application was reviewed yet. As rtor1 said you should get your senator involved in your case. I hope that you guys will hear something soon!!! Best of luck!!!
