Hi, I'm horrible at intros so I'm going straight to the point. I have been married for a year now and am starting the spouse visa for my husband. Im a u.s citizen whoe is in college right now.(stressful without my husband) I want to know what are the forms I need for the spouse visa. Everytime I feel like I'm done with the forms I read about new ones. OK so far I have: the i-130, g-325 for my husband and I ( how much should I send because I heard that I should give them 5 from each), the affidavits, birth certificate for both my husband and I( should I send originals or copies?), marriage certificate ( again, originals or copies to send?), passport copies, 2x2 pictures for my husband and I, I also added my wedding invitations, pictures of the wedding ( how many should I give them) and that's basically it. I thought of adding my school records for proof.. what do u think? What other forms or things am I missing.. also, the i-864, what is it and do I have to send it with all the others .. please help me. I'm stressing over all of this.. thank you so much

congrats on your marriage. Best wishes

  • Cr1 process will take around 12 - 14 months to complete
  • If its DCF then 6-7 months (not sure about exact time frame coz our is CR1 filed from US)
  • If you have proper document and your relationship is true and if you can prove the same with evidence, there should be no issue
Our is 20+ years of difference :goofy:

What is a dcf? How is it different from a cr1?

DCF=Direct Consular Filing

At a few Consulates petitioners who are permanent residents of that country can file their I-130 petitions at he Consulate.

Cuts the time down to a 3rd. Yemen isn't one of those countries though.

The DS-260 is an online form that will be completed at a later stage; it is not submitted with the I-130.

Something also to consider is who will be your joint sponsor if you don;t make enough. If its just you two right now the poverty guideline is $19662. But that is later after approval at USCIS when you are at NVC. But you need to have that pon your mind.

You might want to add some communications in that evidence not just we got married stuff. You need to show evidence of an ongoing bonafide relationship. Yemen is a tough tough embassy so Facebook, emails, IM's Skype call logs you should show a sampling of that. Pictures you ask don;t get crazy like maybe 20 at different venues a few wedding pics showing you with family and friends or him with family and friends.

Do not send originals to USCIS you will need those for NVC. Just photocopies at USCIS.

Don't stress read the guides so you know exactly what is happening and what you need. Read also in my signature the NVC Process wiki that stage is after USCIS you need to know the whole process.

Read interview reviews for your country if there are any in the portal for Yemen.

Thank you so much. I have something that I just thought about. He emails and call logs you said, do they have to be translated if they are in another language? I have plenty of emails but they are not in English. And the call logs because I was married in Yemen, the logs are going to show my Yemen number which is disconnected now. Is that OK? I have around 10 pictures of both of us from my wedding and after the wedding, I also have the wedding invitations translated and all.

Hello Lauren:
As Visquieries has pointed out, you seem to be confuising the visas. You are already married, so forget about the K-1 visa. The immigrant visa that you are interested in is the spouse based CR-1 since you have only been married one year.
It is apparent that you are getting ahead of yourself and really confusing your task by not zeroing in on the first forms to be submitted. I don't know where you would have gotten the idea of 5 forms for anything. The instructions for the forms specify what is needed as far as original photocopies or extra copies. Your own college transcripts have not relevance to anything on any of the forms.
You need to follow the precise instructions on the forms being careful not to follow advice given online that is not very recent.
If you have not read the link that Visaquieries recommended, you should certainly do so:
You should also follow:
http://travel.state.gov/content/visas/english/immigrate/types/family.htmland their associated links for the entire process.
Right now, step in to get your feet wet with the first forms (I-130 and G-325a) and the requested supporting documents only as required for those forms. While you are awaiting the approval, begin working on the other documents that must be gathered for future forms that will be requested of you.
Settle down for the long wait. Find activities that will divert your stress. When you get to the stage where the NVC (National Visa Center) has your file, their help line can be very helpful in the tricky questions specific to your case. Feel free to dial them, turn on the speaker phone, and expect a 45 minute wait before you get to an attendant that is normally very helpful and mostly encouraging.
There is one major exception to following the aforementioned links to the letter. Form DS-230 has been replaced by online DS-260. It will not be available to you until you have fulfilled prior steps. It is filled out and submitted directly on line and will involve a considerable amount of precisely dated background information that only you spouse will know. Don't take it lightly. I will let you search for further information on that.
This information is coming to you from a person who has not yet completely finished the process, so you can judge any advice accordingly and as it might apply to your case.
Good Luck

I very much appreciate ur help. The reason why my Bio has the k3 is because I didn't know the exact name of the spouse visa. Also about the school records, I wrote this letter to USAID and thought of adding my enrollment verification for proof that I am a student and that i dont want to go back to Yemen because of the civil war hapeneing right now. All my friends who are married say that their visas for their husbands took about 2-5 years. I don't want mine to take that long, especially since Yemen is an unstable country and that the embassy there is harsh. And also because I don't want to postpone college or be seperated from my husband for that long. What do u think?
