Many people visit whilst the process is ongoing, I did. The fraud bit would only apply if you were looking to use a Visitor Visa to immigrate, and then that is more theoretical.

Her problem is applying through a Consulate where it would possibly be difficult to get one anyway and having an immigrant petition in process does not help, easy for them to say just wait for the immigrant visa.

Thanks for the response I called uscis and they said it would not be an issue as long as we mention it when arriving at us customs and as long he returns within the allocated time period. So in case anyone else is curious about this topic.

Yes, but remember. The customs officer at the airport could deny your fiance entry to the US and send him home on the next flight out.

Most unusual for a Customs Officer to be involved with a deportation, and also unlikely for an Immigration Officer to second guess a recently issued Visitor Visa.

Really? Even after the visitor says he/she is coming into US to visit fiance whom has already applied for a K-1?

There is a whole thread about it, but was not an issue for me and many many others.

There will always be an exception, but most of the time people with issues when seeking entry as visitors have a story to tell.

The operative word here is could. Just trying to give the op a heads up to this fact. As you say it has happened, therefore I believe it could happen again.

That goes for any entry. US citizens excepted.

it is one thing if you already have a tourist visa, and a whole different ball game if you don't and are applying to get one. not to mention a big factor depends on which country you are coming from.

it is one thing if you already have a tourist visa, and a whole different ball game if you don't and are applying to get one. not to mention a big factor depends on which country you are coming from.

you can spend the money on the visa and get it but the drama comes when you enter the US the immigration officer can deny you entry, even if you tell him the truth that your visit your fiance and you have a pending K1, he COULD still send you back but the harsh part is if he isnt satisfied with what your saying even if its the truth, send you back and revoke ur visa, money wasted. I say it is up to you to take the chance but no matter what you do TELL THE TRUTH AT POE.

There is lots of people in this forum who are in K-1 process and come here to visit, see each other....for christmas or things like that.

It's very important your fiancé shows proof of coming back to his country. It's NOT fraud if the idea is not to immigrate.

Also to those who say could be denied at POE that can happen with any visa... With ESTA..... Everybody who isn't a USC can be denied. But I would totally apply for it, I don't see it as an issue, if they don't approve it then just keep waiting for your K-1 you won't lose it don't worry

My fiancee is coming to visit my family middle of this week on a tourist visa! There is hope.

Hey guys I was just wondering if it would be an issue if my fiancé applies for a tourist visa while we wait for the our k1 visa to process that way he's able to visit since I don't always have availablity to with work and hopefully we can see each a bit more. Thanks in advance for your help

Guys, you are all misinformed. It is possible. Here are my proof.....

#1) My co-worker and his fiancee at the time, went through K1 process and while they were waiting, his fiancee came to visit him for a month.

#2) My fiancee also got a tourist visa and will be coming in middle of this month.

Sure they can try. No guarantee, no fraud as long as they return within the expiration period.

It wont be an issue. Your fiance is free to apply for a tourist visa. But since your fiancee already has the intent to migrate, it might be a very very slim chance of getting a tourist visa approved. If you dont mind spending extra on it, go right ahead. Hoping for the best!

USCIS does not issue the travel visa. This is done at the local embassy and will be up to them. I have not seen any travel visas issuesed to VJers from JA while going through this process...

I know they do not issue the travel visa I was calling them to determine if it would conflict with the k1 application process in terms of fraud, that was my only concern I didn't want there to be a red flag

No asking for a tourist visa while a K-1 is processing is not fraud.

did your fiance get her tourist visa BEFORE you applied for the K-1 or AFTER?
