Hi everybody , i ve read a lot of posts that say it s ok to file aos after i 94 expires,but i wanna make sure ,right now we are a lil short on money and that s the only reason we might file aos maybe 2 weeks after my i 94 expires.Is it ok to file it after the 90 days ? will there be a problem at the interview for filing after the 90 days?

We are already got married and i got my ssn card and we have almost all the forms ready to post, except the i 693 medical exams, i won t even do it cuz the civil surgeons asks 600 dollars to do the full exams and i have to travel 500 miles away not affordable right now, and i had my medical twice on my country cuz the first one expired and the second time i had the medicals was june and i was told that i had all my shots done,do u guys think not sending the I 693 form is it gonna be a problem?

Please give me some answers and thank u very much.

It's Ok to file after expires don't worry.

But I will recommend you to look for a different doctor. I paid $320 here in the states and that was expensive!!!

If you have everything visits are cheaper. ( my visit was $155 but I was missing a couple shots, I've read people who paid around 100 dollars )

just a quick recommendation if you have your own health coverage you can do any required medical stuff with them and (get copies of everything) then call around to USCIS doctors and tell them you did everything and just need to have the papers filled out and it wont cost you as much

Jan 29th 2008 Missed telephone call from USCIS

Jan 30th 2008(my birthday) Returned phone call from USCIS AO (much nicer then original) personally called to confirm my mailing address an advise I am approved an will recieve 10yr card as I have been married more then 2yrs.

Feb 11th 2008 10yr greencard recieved in the mail with wrong info on card.

Feb 12th 2008 Start planning trip home to Australia

May 3rd 2008 Leave for Australia

May 5th 2008 Touch down in Australia 1st time since Dec 28th 1995 what a relief.

May 5th 2008 Suprise my grandmother with showing up at her door. Tears all around but well worth it.

May 25th 2008 Say Seeya Soon as I hate Goodbye...Come back to the US and start thinking about when We will wanna go home again.

This has been discussed many times. You can do a search for it here on VJ.

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

If you had all the required vaccinations by the time you had your K-1 medical and they are marked off on a properly filled out DS-3025, then you don't need to see a civil surgeon. Since USCIS hasn't approved our EAD yet for our AOS, are we still able to work, or just reside in the US while the AOS is pending?

I believe you need EAD / AOS (Green Card) in able to work, and yes you can reside in US while AOS is pending.

You are in a period of authorized stay in the US while your adjustment of stat\us is pending. You will need the new EAD in order to continue working though. Have you asked about getting the EAD expedited due to the fact that yours is about to expire and you need to continue working at your job legally? They have approved expedites for having a job offer, so go ahead and try asking for one. The EAD takes 60-90 days to be approved after filing for it with AOS.

Thank you, the 90 days is already gone past, since our AOS, EAD and AP went in on May, 23rd.

I am self employed and my wife has a job, so and EAD would be great right about now. Problem, is....I also have an I-601 pending that may hold the EAD up. I am not sure if I can request an expedite, since I think my whole application is pending on that process too.
