If I go to the US on a K-1 visa, get married, can I leave to return to the UK? and file for my Adjustment of status while I am in the UK and then officially move over there once it comes through.

I am hesitant to give up my home and job and be left with nothing if something falls through.

No.

You cannot travel (or work) until you have EAD and AP, which takes 2-3 months, on average. If you leave, sicne the K1 is a single entry visa, your US husband would need to file for a CR-1 spousal visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

By then, you would be married to your fiance. AOS isn't all that difficult. I dont know what you think will "fall through" right after you get married.

You can come to the US, get married, return to the UK, and file for a spousal visa.

The other option is what Penguin told you.

I understand your concern, but if you have a solid relationship there is nothing to worry about. If you haven't filed for the K1 yet, you can get married and file the I-130 for a spouse visa.

This will allow you to apply for an immigrant visa abroad and then you can actually give up your job and your home once you have the visa in hand. As soon as you enter the US you will be an LPR, although you will still have to do ROC after 2 years.

If you have already filed for the K1, you will need to get married within 90 days of entry with the K1 visa, file for AOS and apply for and receive an EAD/AP doc before you can begin working or to travel.

And how do you think you're going to do biometrics ? Or an interview if called for ?

I am wondering what you fear is going to fall through...the marriage or greencard approval?

If the voice in your head is telling you to wait, then listen to it. It is not going to be easy starting out with a husband making only $16k per year. K1s have a struggle when they arrive and being below the poverty level will suck even more. You won't be able to work, get a driver's license, OR leave the US for months. Yes, it only takes three months after applying, but factor in how long it will take to marry, get the marriage certificate back, and get the applications sent off before that 3month timeline can start. And consider if you have enough saved to cover the costs. These are minimum required but there is also two trips to London, passport photos, moving/shipping, wedding, etc.

K1 London route = $1705 + £290

$340 (USCIS) I-129F petition

£45 (ACPO) Police certificate just before petition approval

£245 (Knightsbridge Doctors) medical exam. Pay at exam.

$265 (Embassy) Visa fee prior to interview. Online pay.

$30 Courier fee if home delivery, $0 to pick up at a depot. Online.

$1070 (USCIS) Adjustment of Status/Work Authorization/Advance Parole
