Regarding the financial requirements for the K1 fiance visa, do applicants meet the financial requirements for the K1 fiance visa if they can prove a combined annual income of $18,912, even when they may be using their earnings to cover their living expenses? Or are applicants required to have a specific amount of savings, and assets, in order to meet the financial requirements? Can you please tell me what the exact financial requirements that applicants must prove, are? Can applicants combine their assets, jointly, in order to meet the financial requirements? Or is the USA sponsor required to meet all of the financial requirements, without any financial contribution from the non-USA foreign fiance? Can you please explain to me the exact financial requirements for a K1 fiance visa, as it pertains to each party of the engaged couple? THANK YOU VERY, VERY MUCH!

The petitioner must be earning 125% of poverty guidelines ($19,662). To some extent, savings/liquid assets can be used to offset income. Otherwise, a cosponsor will be needed to meet the requirement, which is not accepted at all consulates for k1 visas.

Above answer is correct, it is all on the petitioner.

Though you'll be filing I-134, I-865 instruction form has more relevant information that can also apply to I-134.

While I agree that its totally petitioner's burden to provide the affidavit of support (and not the beneficiary)...

not that it happens often at all, but if the petitioner is poor but the beneficiary is rich,

I am just thinking out loud that beneficiary should be able to give (large) gift money to

petitioner to boost the affidavit of support requirements....No?

Yes that is technically possible (opening a joint account in the USA to transfer money into is one of the things we did, I earned significantly more than my husband while we lived abroad, who was unemployed at that time), or even transfering assets/ money into the US citizens name. The problem with that is that USCIS may see it was you "buuying the greencard", so be careful. Also, they prefer steady income to using assets/bank account savings, and income abroad does not count.

The PETITIONER must have income to at least meet the poverty guidelines of the I-864P, for two people that is $19,662 (gross income). Beneficiary's income does not count.

As for assets, some embassies do not accept assets to make up a shortage.

My fiance and I just need some assistance on the entire process. Although I know it is available in the website, it's still different to talk with someone who really has tried the entire process.

My fiance (sponsor) will visit here in October and she will stay for almost 2 months. Is there anything we can process while she is here? Do we need to have that financial proof as early as now? Or is this something we can provide later on?

Will W-2 be sufficient? A copy of contract showing Annual Salary?

And there should be no other steps for same sex application right?

Your inputs on this is greatly appreciated!

Thanks,

Van

You can sends the petition fro the Philippines if that is what you want

The I-134 is provided at interview stage, not with the petition.

Usually people provide a tax transcript, paystubs and a letter from the employer stating salary and that it is a stable job.

No special steps for same sex applicants, no.
