We sent our AOS packet last Monday (7/14/2014) thru Express Mail and it was received last Wednesday (7/16/2014) and Signed by JC. Until now we haven't receive any text or email notification from USCIS even though I included form G-1145. I dnt know if I should start to worry.

No, I have not. However, they cashed the check I issued them so I am certain that they already have my package.

Note that I did not include form G-1145 when I sent my AOS package. I am just waiting for my NOA so I can get my receipt number and sign up for notifications online.

Oh OK. We did include form G-1145 in our submission though so I am expecting for the text/email notification to get sooner than the actual NOA1 letter from USCIS. We have to check if our cheque has been cashed though.

Don't worry. Wait until next week. Did they cashed the check?

Sorry, I did not read this post. G-1145 is not really reliable. I've only got notification by emails not by texts.

I sent mine and my sons Aos paperwork on the 23rd of June and they signed for it on the 24th, I only received the noa1 papers on the 19th of this month and received no text or email from them even after having filled out the form so have faith and don't worry yet!!! Good luck!!

Filed last month, no check cashed and no NOA1 either through mail or electronic. The question I have is... since it was received by USCIS before the 90 day K-1 Visa expired is overstay accumulating? I have a Fedex proof of delivery that shows it was filed before the 90 days ran out. Seems a bit unfair if that's the case.

I think it doesn't really matter.

The 90 days thing is a deadline for you to get married in, not for the filing of the AOS. You're not accumulating any overstay :)

They are not accumulating because once you file for AOS you are in a new period of authorized stay. However, someone whose I-94 has expired and has not filed for AOS yet is in fact out of status and accruing overstay/unlawful presence. There is no deadline to file for AOS if you married within those 90 days, but being married by itself provides no legal status.

Sorry, I was responding to the OP's situation specifically, as they'd applied for AOS so don't need to worry about overstay. I didn't mean to suggest that simply getting married provides immunity from overstay.

I understand. I just wanted to make that clear for anyone that may read this because there are quite a few people that believe that if someone entered on a K-1 and married within 90 days, then they are out of status in some kind of special way that is not unlawful.
