I have an F2B Petition filed in July 2006. The last time I checked Visa Bulletin, they are processing August 2003.

I have been working online since 2006. I have an employer who is considering to sponsor me. He is based in Florida. My question is, can I have a Work Visa and wait for my petition at the same time? Will my petition be canceled the minute my employer and I do the processes needed for a Work Visa? Can I stay in Florida in the mean time while waiting for my petition to reside in Colorado?

Thanks!

Sort of depends on which Visa he is looking at.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

You can have 2 different petitions filed for you by your parent or employer.

An employment based petition will not cancel the family based petition, and vice versa.

A work visa that does not allow dual intent would be tricky.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
