Hello VJ,

I am in need of some help. I am filing the I-864 (AOS) and I’m a little confused, well maybe a lot confused. I have read through some forums and I’m getting mixed answers and can’t seem to find what I am looking for. I am a US Citizen & I’ve petitioned for my spouse and our unmarried 16 year old child, they will be immigrating together, and I am the only sponsor.

I-864:

On part 2 (Information of the Principal Immigrant) I listed my spouse’s information.

On part 3 (Information on the Immigrant(s) You are Sponsoring,

I believe I am checking “yes” for number 1 and also checking box2 which reads: I am sponsoring the following family members immigrating at the same time or within 6 months of the principal immigrant named in Part 2 (my spouse). Do not include any relative listed on a separate visa…My first thought was to add my child’s information, but then I was informed I needed a separate I-864 for my child. Is this correct?

If this is NOT correct, do I enter my spouse’s AND child’s information in the section that says Family Member 1 & 2 or just my child’s, since my spouse is listed in the Principal Immigrant part?

If this IS correct and I do need a separate I-864 for my spouse and another for our child;

On the I-864 where my spouse is listed as the Principal Immigrant, do I list our child as “Family Member 1”?

And

On the I-864 where my child is listed as the Principal Immigrant, do I list my spouse as “Family Member1”?

I was informed you do not reference the other person, on the other's I-864, which confused me since Part 3 ask about Family members.

I apologize if these question(s) have been asked a million times, I’m getting mixed answers, the I-864 instruction doesn't seem to read well or I am over thinking, because I want to get this right the first time and I'm very nervous about making any mistakes on these forms.
