Hello. My fiancee was interview today and was unable to complete due to me not working for a 1.5 years since my arrival to the States. I was in Philippines from 2009 thru 2012 going to school for my BSN. During the time of my arrival I was applying for my ATT for NCLEX. It took about 9 months back and fourth for me to get my ATT. I thought you could have a co sponsor to help out since I did not do anything but review for the NCLEX. My mom is currently supporting me. She makes 6 figures a year with about 100,000.00 in the bank plus other assets. Has anyone one gone through a situation like this. The interview is asking me for w-2 forms 2013 and current sustained income. If i were to marry her would she still get denied? Thanks in advance if any.

Are they asking for that info on you or on your mom? Is your mom listed as a co-sponsor? Did your fiance have her ITR at the interview? It could be just a matter of getting your mom's financial data to USEM but we need to know these specifics first.

They are asking that information on me. My situation is that I didn't work the 1.5 years that i was here staying in the US. I understand that I have to make 15,000.00 a year to qualify. But I didn't cause i thought if you had a co sponsor making well above the federal government line you would be ok but it didn't work.

The US embassy in the Philippines rarely accepts joint sponsors for a K-1.

You should have done your homework! You thought that because your co-sponsor (Mom's) income was sufficient that that would work? Have you bothered doing any research on the matter? Apparently not. As a consequence, you put your fiance in an embarrassing and precarious position. Not to mention all that she had to go through on her end to get to the interview!

The lack of effort on your part to clearly understand the guidelines (pretty simple, really), and to get the info necessary to determine if you would qualify (pretty simple, again) - is stunning.

And, yeah, you do need to have your own income - from a job or somewhere legal.

At the very least, you owe your fiance an apology.

Sorry if it seems I'm lecturing...but, really, you had ample time to figure this one out.

As already mentioned, Manila accepts a joint sponsor on a case-by-case basis for K-1s. You could get married then the Embassy would have to accept a joint sponsor.

Now would be an idea time to pursue a CR-1 if you need a joint sponsor, the approvals for Philippines cases are done rather quickly because of Typhoon Yolanda.

Come back home work and wait another year for my w2 forms least making 15k in 1 year.

If you are intending to meet the poverty guidelines for your fiancée and yourself, you will need closer to $20k. 15K will not be enough.

USEM is very difficult about accepting co-sponsors with the K-1 visa, most of the time they to refuse to accept a co-sponsor.

If you get married and file for the IR/CR-1 visa the embassy has to accept a co-sponsor.

If she was given a 221g, submit docs for joint sponsor and hope that USEM will accept it.

If she gets denied for the K1, get married and file i130 for CR1. It could take more or less a year.

For two people requirement is $19,662.

What forms did you and your mom complete for USEM?

Thanks again for the replies. We submitted I-134. I gave my fiancé my form with 10k in the bank with 0 employment. My mother gave her I-134 with her W2, Statement of employer, statements of bank accounts and other assets. I really hope that lady luck is on my side. I will not give up. It's another trial for us in this journey.

As of right now my only other option is to get married file for cr1. Pass my NCLEX boards and work with the aid of my co sponsor and hope for the best.

Whoa - slow down a moment.

IF YOU DID NOT SUBMIT evidence clearly stating/showing your lack of income

then the co-sponser stuff CANNOT be properly evaluated at the IV Unit.

So - restudy / relearn on what you need to submit - as the IV Unit is asking for STANDARD things that they want to see - and [my opinion] you don't have anything in that list that would prove you up as a sponser - or even things to COUNTER the things in that list to prove up that you FAIL the bar to be a sponser ...

So - do some more research - practice writing up letters of attestation along the way - and submit when yer ready.

IMO - once you do that - the CO-SPONSERS stuff will be evaluated , properly, and a Vice-Consul will recommend issuance.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Did you mother submit her 2013 tax return along with the W-2? Tax return is required. Letter from you stating you were in school and are not striving to pass your board exam would help also.
