After all the hoops we have jumped through, 4 days into my new American job USCIS emails me.....

Why you received this email

Your employer participates in E-Verify, a program managed by the U.S. Department of Homeland Security (DHS) and the Social Security Administration (SSA). E-Verify compares the information you gave on Form I-9, Employment Eligibility Verification, with records available to DHS and SSA to verify that you are authorized to work in the United States.

You received this email because E-Verify provided a result of DHS or SSA Tentative Nonconfirmation (TNC). A TNC means that the information entered into E-Verify by your employer does not match records available to DHS and SSA. A TNC does not necessarily mean that you gave incorrect information to your employer or that you are not authorized to work in the United States. What you should do

If your employer has not spoken to you about the TNC, you should ask your employer for a copy of the Further Action Notice. Employers must promptly notify you in private of a TNC result and provide you with the Further Action Notice.

Employers must also allow you to contest (take action to resolve) a TNC and may not take adverse action against you because of the TNC while you are contesting the TNC and your E-Verify case is pending.

If you decide not to contest the TNC, your case will become a Final Nonconfirmation, which means that your employer may terminate your employment.

What is this? Does anyone know? Is there ever any escaping USCIS hell?

Oh how annoying. There is a mistake somewhere in your records to sort out. Did you read the list of possible errors?

An SSA Tentative Nonconfirmation may occur if:

Your citizenship or immigration status changed since you last received your Social Security number.

You changed your name but did not report the change to SSA.

Your name, Social Security number or date of birth was recorded incorrectly in SSA records.

There is another type of mismatch with your SSA record.

Your employer did not enter your information correctly in E-Verify.

The name you provided on your Form I-9, Employment Eligibility Verification, is not consistent with your name in SSA records.

A DHS Tentative Nonconfirmation may occur if:

Your name, A-numberI-94, and/or foreign passport number were recorded incorrectly in DHS records.

Your U.S. Passport, Passport Card, drivers license or state ID card information could not be verified.

Your information was not updated in DHS records at the time your information was checked in E-Verify.

Your citizenship or immigration status changed.

There is another type of error on your DHS record.

Your employer did not submit your information correctly to E-Verify.

The name you provided on your Form I-9, Employment Eligibility Verification, is not consistent with your name in DHS records.

So did the employer enter the data correctly?

Did you go back to Social Security with your greencard to update your records to permanent resident? There are many possible hiccups and a formal process for contesting the notification while you go to SSA and USCIS to sort it. It's probably easiest to go to SSA tomorrow. Ask for a supervisor if you perceive the person helping you is a dummy. And get on the list for an infopass appointment to speak to somebody about your DHS records.

My employer asked me to log into HR and contest it. I called Everify and they told me to go to SSA. Am currently waiting in line here on my lunch break. 90 minute wait :)

I am an HR manager and I E-verify new employees daily. Employers are required to verify that you are legally eligible to work in the US. This is done online using E-verify. When you filled in your I-9 form did you tick the correct box for permanent resident/resident alien? If so, then it is possibly your employers fault. they may have entered you as a citizen which is where the discrepancy would be. If you and your employer entered everything correctly, then it is the fault of USCIS and they are the ones that need to fix it. The department of homeland security is the bureau that is responsible for I-9 forms.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

If you are who you are -

and all of your docs and numbers are correct

then I posit -

this is a back-end data problem with E-Verify -

where a 3rd party company is utilized to prove up that you are you

and

this is mostly based on a credit history report....

It's a snafu - to be certain - but I would recommend instead of chasing yer tail on this (and you will - between SSA and DHS and CBP and and and ) - get yer Immigration Liason Staffer involved - that constituent liason at the Congressman's office - as the DATA stored by that third party does NOT contain any info on you so E-Verify cannot be used automatically.

It'd be nice or nicer if SSA data was checked by E-Verify - right?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Well I went to SSA. They said they *think* the problem lies with my name as at POE my first name was entered as Stefanie-Ann , as one long name, where as they are actually two separate names. My first name and middle name.

So she said it can take up to 3 weeks to change. I said, "Can I give you my verification number? It says on the email im supposed to give you this number". She looked at me blankly and said she didn't know what I was talking about. When I got back to my desk at work the HR lady said that I would need to go again as the SSA are supposed to take my I-9 verification number on my Further Action Notice.

How annoying! I'm not sure there is any escaping the USCIS...at least not for another 3 years if you go the citizenship route! Hope they clear everything up soon!

ok - so is problem generated at the port of entry - the POE -

so to fix your name -

get into (no calling on the phone) a CBP office - could be deferred inspection or airport-attached -

talk with the shift supervisor -

and get your name in the SAVE database corrected there.... Don't leave till you get a shift supervisor - and avoid talking about your problem with the clerk at the desk - they are as poorly trained as the SSA staffer you met up with recently.

Then wait a week - as SAVE db updates are done in batch mode - nothing instantaneous there...

Then when you go back to the SSA office - ask for a shift supervisor - then go over all the stuff again.....

I think if she has a greencard already, then what her I-94 entry via CBP says shouldn't matter. The immigrant name updates with each new status granted by USCIS. I would think she needs her greencard exact name in her SSA records, not her entry name.

We went to SSA to update them with the greencard and again with the naturalization certificate. He kept getting a new cards because of DHS changing the name.

John Doe (first SS card based on I-94 and CBP entry)

John J. Doe (changed SSA records to match greencard name)

John James Doe (yet a new SS card issued because naturalization records were full name)

I have the same case with the OP. I informed my employer about the TNC and he said he did not receive any notice from E-verify regarding my case. He said he will call me back. Two days had passed but no call from him yet. I suspect the fault was on the EAD card number. I remember the guy from HR filled in my USCIS A# instead of the EAD card # (felt bad that I didn't check him right away). I cannot make a call with the DHS nor SSA to check it since I have not received Further Action Notice from my employer yet. This is so frustrating as I am excited to start my work on Monday.
