Advice on 90 days during K1

Hi, sorry for another thread, but I'm trying to make sure I have everything lined out before we start booking flights.

Our current wedding plan is October 5th.

Miscellaneous notes

  • In Missouri, you have to have a social security number to get a license to marry (not sure if immigration changes this requirement any)
  • If we wait 2 weeks before we apply for social security card, that's 14 days.
  • It takes I believe up to 2 weeks to get the social security card in the mail. Another 14 days. 28 days total.
  • After you marry, it can take up to 2 weeks to get a certified copy of your marriage certificate.
  • You need a copy of your marriage certificate for the Adjustment of status paperwork
  • You need to submit the adjustment of status paperwork before the 90 days is up

So would this be the correct route to go?

Day 1: POE
Day 14: Apply for SSN
Day 15: Ask at least for SSN (while waiting on card)

Day 28: Hopefully get SSN card in mail
Day 29: Apply for marriage license
Day 45: Marry
Day 61: Hopefully receive certified copy in mail

Day 65: Submit AOS

Is that enough time? Has anyone else in Missouri got a marriage license without having the SSN card yet?

You do not need a SSN to marry.

There is no requirement to submit AOS within the 90 days.

You have to marry within 90 days of date of entry into the US.

Well this is what I was reading and thought it was required.

What would you recommend? Calling my local recorder of deeds?

I would certainly call them to confirm. I was married in indiana and their website says the same thing but when we called we were told it only applies if you have one. I only needed to take my passport as proof of identity and got married without any problems.

Thank you for the advice. (Not enough people do that on here these days :))

I got my social security card less than a week after I applied.

Agree with others on SSN will not be required. My county website said the same thing. I called and she said if you have a SSN, then it must be given, but if you don't have one, no problemo. In our case the foreign passport as photo ID was sufficient.

Agree no time limit on AOS, but of course the sooner the better so you can get on with being a somebody in America other than a K1 nobody understands.

Marriage certificate: Typically the minister (officiant) signs the license and mails it in to be recorded by the county and they get around to it whenever. When you go purchase the license, ask a lot of questions. if you bring it in person the next business day after the wedding, will they be able to record it while you wait? Kinda play the immigration card and act like you need it to get her greencard ASAP. Beg a little. We had our certified copy of the marriage certificate by noon the day after the wedding. No begging required. They suggested it. Try it.

Waiting 2 weeks before going to Social Security: with the automation of the I-194, I don't think you have to wait that long. It should all populate quickly.

Wedding date: October 5th is our anniversary. Five years ....errr no it will be six years. Time flies (except when you're waiting on immigration).

Where we got married (Marin/CA) they reprinted certified copies for us a few days later. I just walked in with our wedding cert original and they did them while I sat there.

We walked our marriage certification in, as well. The registrar wasn't in that day, but my husband explained why we were walking it in, paid the fees for the certified copies for the AOS, and they left a nice note for the registrar. He got it the next day, signed everything and mailed us everything; we had it two days later. So that's definitely an option for fast. (We didn't bother waiting for him to get his SSN before we filed the AOS paperwork; at least in PA, they're not giving you the number right away anymore, and we didn't want to wait the 10-21 days for the card to show up.)

Ok maybe I'm confused.

I thought, and please, do correct me when I'm wrong here, that once you entered the country you had 90 days to get married.

If you didn't get married, then she/he would have to go back to their home country and you have to do this all over again.

Once you did get married, before the end of the 90 days, you had to at least submit the AOS paperwork, otherwise at the end of the 90 days she was technically no longer legally in the country...

if that's not the case, what happens then if you get married before the 90 days but don't submit the paperwork for AOS until like, I don't know, day 120?

You are here out of status and are deportable.

Your visa requires you to marry within 90 days. It has no AOS requirement date. Nobody will come looking for her on Day 91. You can submit AOS on Day 120 and still get a greencard, no hassles. After a year (I forget the time actually) you might be required to submit an I-130 spouse petition with the AOS.
